SUMMARY EXPLANATION:
A Notice of Intent to Annex was received on December 18, 2018, and accepted by Council on
February 19, 2019. The Petition has been drafted and signed by 100% of property owners, as
certified by the Yakima County Assessor on May 13, 2019. The legal description of the
annexation area was certified by the Yakima County Engineer on May 9, 2019. The 96th and
Tieton Annexation contains approximately 9.7 acres of R-2, R-3 and B-2 zoned property.
The Public Hearing notice has been provided to all Yakima-area media, including to Decides',
KDNA Radio, El Sol de Yakima, Hispanavision, Bustos Media, and El Mundo.

ORDINANCE NO. 2019-
AN ORDINANCE annexing the 96'h and Tieton Annexation area to the City of Yakima,
contingent on Yakima County Boundary Review Board approval.
WHEREAS, on December 18, 2018, the owners of not less than ten percent (10%) of
the acreage in property within the proposed 96th and Tieton Annexation submitted a Notice of
Intent to Commence Annexation, pursuant to the alternative direct petition method form of
annexation found in RCW 35.13.410 through RCW 35.13.460; and
WHEREAS, on February 19, 2019, the City Council, at an open public meeting,
accepted the Notice of Intent to Commence Annexation as presented, including the information
that the current zoning of the property is consistent with the City's comprehensive plan, that the
properties will be taxed at the same rate and on the same basis as other parcels in the City, and
that the properties would be subject to any outstanding indebtedness to the City, and directed
staff to draft the petition and collect signatures from property owners; and
WHEREAS, following acceptance of the Notice of Intent, Petition number 19-01, was
drafted and circulated for signature; and
WHEREAS, the proponents presented the City with petitions, consistent with RCW
35.13.420(3), reflecting the signatures of parties who own a majority of the acreage in the
proposed 96th and Tieton Annexation area, and on May 13, 2019 the Yakima County Assessor
issued a Determination of Sufficiency which identifies that the owners of a majority of the
assessed value of the property signed the petition, consistent with RCW 35.13.420 and
35.21.005; and
WHEREAS, the 96th and Tieton Annexation area is approximately 9.7 acres of
unincorporated Yakima County, contiguous to and generally located North of Tieton Drive and
West of South 96'h Avenue, including adjacent rights-of-way; and
WHEREAS, the assessed value of the annexation area is approximately$1,044,300
which is expected to generate approximately $2,938 in property tax revenue to the City of
Yakima. In addition, expected development in the area will be processed by the City of Yakima,
which will generate permit connection fee revenue along with increased property tax revenues
as development occurs; and
WHEREAS, garbage and refuse collection within the 96th and Tieton Annexation area is
presently capable of being served by Yakima Waste Systems, Inc., under authority issued by
the Washington Utilities and Transportation Commission (WUTC) to both residential and
commercial accounts and the City desires to provide such services to residential accounts only
in accordance with RCW 35.13.280; and
WHEREAS, RCW 35.13.280 requires the City to grant Yakima Waste Systems, Inc., as
the current WUTC-authorized provider of garbage and refuse collection and disposal service
within the 96th and Tieton Annexation area, a franchise to continue such service to residential
properties within the 96th and Tieton Annexation area for a term of not less than seven years
after annexation becomes effective, such franchise does not apply to garbage and refuse
generated by commercial establishments because the City does not provide or contract for such
service.

WHEREAS, pursuant to due and legal notice, the City Council held a public hearing on
said annexation on July 2, 2019 and;
WHEREAS, the City Council has been fully advised and finds that all statutory
requirements have been satisfied in order and accomplish the proposed annexation, and that it
is in the best interest of the City and its residents to annex said property; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Findings
1. The annexation petition requirements of RCW 35.13.420 have been satisfied by
annexation petitions signed by the owners of a majority of the acreage of the 96th and
Tieton Annexation area.
2. The 96th and Tieton Annexation should be annexed to the City of Yakima.
3. The 96'h and Tieton Annexation property shall be assessed and taxed at the
same rate and basis as other property within the City of Yakima to pay for all or of any
portion of the outstanding indebtedness of the City as incurred before, or existing at, the
date of the annexation.
4. The 96th and Tieton Annexation area's Comprehensive Plan Designations of
Mixed Residential and Commercial Mixed Use shall be in effect.
5. The City of Yakima shall file a completed Notice of Intention to the Yakima
County Boundary Review Board.
Section 2. The real property identified on the map attached hereto as Exhibit "A" and
legally described in Exhibit "B" attached hereto and incorporated by reference herein, referred to
as the "96th and Tieton Annexation," is hereby annexed into the City of Yakima, Washington,
pending approval of the Yakima County Boundary Review Board of the proposed annexation as
presented to it.
Section 3. The 96th and Tieton Annexation area's Comprehensive Plan designation
shall be Mixed Residential and Commercial Mixed Use, and the zoning shall be Two-Family
Residential (R-2) Multi-Family Residential (R-3) and Local Business (B-2), as outlined in Exhibit
"C."
Section 4. The next regularly amended Zoning District Map prepared by the City of
Yakima shall show the 96th and Tieton Annexation area zoned and classified as set forth in
Section 3 above.
Section 5. The City Clerk is hereby authorized and directed to file, pending approval
of the Yakima County Boundary Review Board to the proposal as specifically outlined herein, a
certified copy of this ordinance with the Yakima County Auditor and with the Board of County
Commissioners of Yakima County, Washington, and to transmit a certified copy of this
ordinance to the Washington Utilities and Transportation Commission to notify it of the City's
intent to annex and to provide residential refuse collection and disposal service to the 96th and
Tieton Annexation area.
Section 6. As required by RCW 35.13.270, the City Clerk is hereby authorized and
directed to provide, pending approval of the Yakima County Boundary Review Board,
notification by certified mail that includes a list of the Assessor's tax parcel numbers of all

properties within the 96th and Tieton Annexation area to the Yakima County Treasurer and
Assessor at least sixty days before the effective date of the annexation.
Section 7. There is hereby granted to Yakima Waste Systems, Inc., in accordance
with and for the term provided by RCW 35.13.280, an exclusive franchise to provide garbage
and refuse collection and disposal service to residential properties in the 96th and Tieton
Annexation area for a record of seven years from the effective date of the annexation. Such
franchise does not apply to garbage and refuse generated by commercial establishments.
Section 8. This ordinance shall be in full force and effect 60 days after consideration
and approval of the Yakima County Boundary Review Board, and publication as provided by law
and by the City Charter.

IV. FINDINGS OF FACT:

A. Annexation Procedure:
The 96th and Tieton Annexation was submitted and processed under the "Alternative
Direct Petition Method" in RCW 35.13.410-460. This statute requires that a majority of
property owners in the annexation area sign the petition. For the 96th and Tieton
Annexation, 100% of the property owners signed the petition.
B. Urban Growth Area:
Per RCW 36.70A.110(3),
"Urban growth should be located first in areas already characterized by urban
growth that have existing public facility and service capacity to serve such
development, and second in areas already characterized by urban growth that will
be served by a combination of both existing public facilities and services and any
additional needed public facilities are provided by either public or private sources.
Further, it is appropriate that urban government services be provided by cities, and
urban government services should not be provided in rural areas."
The 2003 Yakima County Wide Planning Policies (YCWPP) includes the following policy
statement:
A.3.12.: Annexations will not occur outside established urban growth areas.
Annexations will occur within urban growth areas according to the provisions of adopted
interlocal agreements, if any.
The City of Yakima and Yakima County Interlocal Agreement (Resolution R-2015-139)
promotes orderly and contiguous development of the City through annexation. In the
preamble of the agreement it is noted "The purpose of UGA designation is to target these
areas for urban growth and urban levels of services, and eventual annexation or
incorporation."
C. Comprehensive Plan Criteria:
The City of Yakima Comprehensive Plan 2040 provides the following criteria, Policy 2.1.9 of
the Land Use Element:
Consider annexation requests in accordance with review criteria, including, but not limited to:
a. Areas to be annexed are included in the UGA.
Staff Response: The total area of the 96th and Tieton Annexation is within the UGA
b. The annexation boundary, where appropriate, should adjust any impractical or
irregular boundaries created in the past.
Staff Response: This annexation will encompass the NW corner of S 96t''Avenue and
Tieton Drive. Currently, the City Limits extend west along Tieton Drive (including only
the rights-of-way) for approximately 350-feet.
c. The annexation boundary should, where appropriate, provide a contiguous and
regular boundary with current City limits.
Staff Response: This annexation area is contiguous to the existing City limits.

d. The annexation proposal should create and/or preserve logical service areas.
Annexations generally should not have or create abnormally irregular boundaries
that are difficult to serve.
Staff Response: The 96th and Tieton Annexation creates a logical service area by
bringing into the city areas zoned for urban development that have access to City
Sewer service, consistent with the City/County interlocal agreement. There is an
existing sewer line in Tieton Dr. that extends approximately 120-feet past the existing
City Limits. Because of the north-south slope and lack of a useable sewer line south
of the 96th/Tieton intersection, the Northwestern properties are the only viable areas
for connection and urban development.
e. The City should give priority consideration to annexation proposals that are
financially self-sufficient or those where the fiscal impact can be improved. The
City should develop a variety of service delivery or revenue enhancing options to
increase the feasibility of annexation. The City will prepare a fiscal analysis of the
annexation proposal prior to annexation.
Staff Response: The fiscal impact of this annexation is minimal, and general fund
revenue will increase as development occurs. The annexation area is largely vacant,
with only three single-family homes in the area. The addition of+/- 10 people is not
anticipated to have any impact to the delivery of City services. As development occurs
and property taxes increase, the City will receive permit and connection fees along
with property tax revenue. The annexation area's assessed value is approximately
$2.93 million, which is anticipated to generate approximately $2,938 in property tax
revenue based on current rates.
As most of the annexation area (4.8 acres) is vacant and zoned R-2 and R-3, it is
anticipated that future residential development will occur. Of the vacant 4.8 acres of
residential land, approximately 1.7 acres is encumbered by floodplain. At R-2 and R-
3 densities, the remaining buildable area could support approximately 31 dwelling
units. The City of Yakima has approximately 2.73 persons per household
(Comprehensive Plan 2040) which would only add about 82 people at full buildout,
bringing the total population of the annexation area to approximately 100 people.

From a fiscal standpoint, the impact to city services is minimal and it is not anticipated
that existing city services would suffer as a result of this annexation. All of the S 96th
Ave ROW and approximately 56% of the Tieton Drive ROW adjacent to the annexation
area is already in the City Limits. Approximately 265 linear feet of Tieton Drive would
be added to the City Limits. New development would be responsible to extend utilities

and frontage improvements. As noted above, when development occurs the City will
receive the permit and connection fees, along with the property tax revenue of the
newly developed properties.
According to the City's 2017 Capital Facilities Plan (CFP), the effective Level of
Service (LOS) for the Yakima Police Department (YPD) is 1.6 officers per 1,000
residents, and the LOS policy is 1.8 officers per 1,000 residents. The addition of
approximately 100 residents at total buildout will generate a need for 0.16 and 0.18
FTE, respectively. The 2017 YPD Annual Report identified an overall 11% decrease
in total crime/1,000 population from 2016.
The Yakima Fire Department (YFD) measures LOS based upon response time.
According to the 2017 Annual Report, the average response time for all alarms was
6:08 minutes, exceeding the adopted 2017 CFP LOS of 8:00 minutes. YFD Fire Station
92 is located approximately 1 mile east of the proposed annexation and is already
providing service in the immediate vicinity. In addition, YFD has an automatic aid
agreement with Yakima County Fire District#12 for calls in this area.
D. Public Comments:
Three public comments were received prior to the February 19, 2019 Council meeting, one in
favor of annexation and two in opposition. The first comment in opposition is from Blake Scully,
who is concerned that the City has adequate financial capability to take on additional land and
still provide adequate police, fire, and public works service. The second comment in opposition
is from Nathan Craig, Fire Chief for Yakima County Fire District 12. Chief Craig discusses the
boundary of the proposal being an irregular boundary.
V. CONCLUSIONS
1. The Petition for the 96th and Tieton Annexation was signed by 100% of property owners,
as certified by the Yakima County Assessor.
2. The 96th and Tieton Annexation is consistent with the applicable criteria found in the City
of Yakima 2040 Comprehensive Plan, the Yakima Countywide Planning Policies, and
the City/County Interlocal Agreement.
3. The City of Yakima has sufficient capacity to serve the annexed area.
VI. RECOMMENDATION TO CITY COUNCIL
The Planning Division recommends approval of the proposed 96th and Tieton Annexation
Ordinance. If approved by Council, the necessary documents will be transmitted to the Yakima
County Boundary Review Board (BRB) for final consideration. If ultimately approved by the
BRB, the Ordinance will be filed and become effective 60 days thereafter.

On April 10th, 2019 a petition for annexation was received by this office for
determinations of the sufficiency of the petition per RCW 35.13.130 and 35.21.005 from
the City of Yakima.
The determination of the sufficiency was begun by this office on the terminal date
of May 13th, 2019 and has now been completed based on the records of this office,the
above-mentioned Certificate of Transmittal, and the agreements and legal authorities
cited therein.
The owners of and real properties comprising not less than 60% of the assessed
value of real property in the areas proposed for annexation are signers of an annexation
petition, and the above numbered petition is determined and declared sufficient.

I am writing today to voice my concem with the proposed annexation of 9.32 acres in the
vicinity of9&h Avenue and Tidoo Drive. Imo urging you|o vote against the recent petition

to proceed with annexation for the land in the area of 96th Avenue and Tieton Dr. With the
recent budget difficulties the City of Yakima now is not the time to add an additional
workload to our public services, with minimal addition to the tax base. I have seen first hand
the long wait times for city residents to receive basic police services. It is not uncommon for
citizens to have to wait well over 3, sometimes 6-8 hours just to speak to a police officer to
make a report. On some occasions citizens are called back and told that an officer would be
unable to respond and to call back tomorrow. This to me is unacceptable and shows that with
current budget cuts and an understaffed police department, the City of Yakima does NOT need
to add any additional workload until the level of service can be increased for the current
citizens of the City of Yakima. Furthermore,the current staffing of the fire department can not
support any additional workload created by annexation. Like the police department,the fire
department has been the victim of recent city budget cuts. This makes me fear that the level of
service I receive will be impacted by adding the additional workload. Lastly, the public works
division struggles to keep up with keeping the infrastructure in the city operational in a timely
manner currently.
I do not believe that the city is in a position financially or with its services to add any
additional workload and I fear that the level of service currently provided will decrease with
the additional workload.

I am writing to submit comments on the proposed annexation at 96th Ave and Tieton Drive, these
comments are for disapproval of this proposed annexation.
This annexation does not fit into the City of Yakima Comprehensive Plan's criteria of accepting
annexation requests that resolve irregular boundaries; in-fact, this annexation would create an
irregular boundary. Currently the city/county line is 96th Ave, this annexation would create a bump
out of seven parcels across the current line which will make the boundary irregular and confusing at

best. Previously this occurred further north of this proposed annexation on 96th Ave and now 8N,
10N, 12N and 14N 96th Ave are all within the city limits yet on the west side of 96th Ave. This was a
mistake that at the time the District thought would not be approved due to creating an irregular
boundary however, the land was annexed and now sits as a small bump out on what used to be a
straight boundary line. Interestingly enough the home that was built for this previous annexation
belongs to a City of Yakima employee and this new proposed annexation has a home belonging to a
previous city council member.
Because this proposed annexation will further disturb what was an easily identified and straight
boundary, the Fire District requests you reject this proposal on the basis of the annexation not
meeting your criteria for resolving irregular boundaries.
