AN ORDINANCE accepting the recommendation of the Planning Commis-
sion and rezoning property at 40th Avenue and Tieton
Drive from R-3, Multiple Family Zone, to B-1, Modified
Business Zone and declaring an emergency,
11 1 WHEREAS, after proper petition and due notice, the Planning
Commission of the City of Yakima held a public hearing on November
7, 1973, on the application of Mildred Cahoon to rezone property
situated at 40th Avenue and Tieton Drive in the City of Yakima,
Washington, which property is more particularly described below,
from R-3, Multiple Family Zone, to B-1, Modified Business Zone, and
WHEREAS, as a result of said hearing the Planning Commis-
sion has recommended approval of such rezone application, and

WHEREAS, on December 4, 1978, the City Council held a hear- '
ing on such application and as a result thereof finds that the
recommendation of the Planning Commission should be accepted for
the reasons that such rezone would be in accord with good planning
and with the General Plan of the City of Yakima; that the majority
of property owners in the vicinity do not oppose the change in
classification; that the needs of the City and community do require
such change and that the highest and best use of said property
is for Modified Business Zone, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission
of the City of Yakima that the following described real property
situated at 40th Avenue and Tieton Drive in the City of Yakima,
Washington, and more particularly described as follows, to wit:
The easterly 115 feet of Lot 2, 40th Avenue Addition,
according to the plat thereof as recorded in Volume
"T" of Plats, page 3, records of Yakima County, Wash-
ington, EXCEPT the east 5 feet for street,
be rezoned from R-3, Multiple Family Zone, to B-1, Modified Busi-
ness Zone, be, and the same is hereby, approved and said real
property is hereby rezoned to a Modified Business Zone.
Section 2. The above change in zoning shall be included
0 and depicted on the next regularly amended Use District Map pre-
pared by and for the City.
Section 3, The City Clerk is hereby authorized and 411
directed to file with the Yakima County Auditor a certified copy
of this ordinance.
Section 4, This ordinance is one to provide for the immediate 0
preservation of the public peace, property, health, safety and
welfare of the people of the City of Yakima and an emergency is
hereby declared to exist and this ordinance shall be in full force
and effect immediately upon its passage, approval and publication
as provided by law and by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this
