ORDINANCE NO. 2..71b/ AN ORDINANCE relating to public services and utilities; providing notice and hearing procedures for suspension of water service; amending Sections 7.68.025 and 7.60.100 of the City of Yakima Municipal Code. ik) BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 7.68.025 of the City of Yakima Municipal Code is hereby amended to read as follows: "7.68.025 Water services charges--When due--Suspen- sion of service--Hearing procedure. A. All charges for water service shall be due and payable at the office of the City Treasurer on or before • the fourteenth day after the bill therefor is rendered. Water service shall be suspended to any premises for which the service charge remains unpaid for a period of twenty- 411 one days after the due date, provided, no water service shall be suspended until a written notice has been served upon or mailed to the customer, at least seven days prior to suspending service. Such notice shall state the date on which service is to be suspended, the amount of delinquent charges and that a customer may request in writing a hear- ing before the customer service manager or his designee to contest the suspension, provided such •request is received by the customer service manager or his designee before the suspension date set in the notice of suspension. B. Upon timely receipt of a request for a hearing, the customer service manager or his designee shall conduct a hearing and the customer requesting the hearing shall be notified in writing ,by the customer service manager • or his designee of the date, time and place of such hear- ing. Pending the outcome of such hearing, no service shall be suspended. C. In the event of a delinquency in the payment of charges for domestic water service to any premises, 411 the City shall exercise a lien against such premises by discontinuing water service thereto and service to any such premises shall not be reinstated until all delinquencies and unpaid charges against such premises for water service, and for cut-off charges, together with a $5.00 reinstatement fee, have been paid. Such lien shall not be for more than four month's charges due or to become due, as provided by law, and shall be exer- cised subject to the provisions of Section 7.68.271 of this title. D. In the event the occupant of a premises is someone other than the customer, the occupant, or in the case of a multiple dwelling, the manager or person in charge, shall be notified in writing of the date of suspension of service and the amount of delinquency at the same time such customer is notified." Section 2. Section 7.60.100 of the City of Yakima Municipal Code is hereby amended to read as follows: "7.60.100 Additional collection method--Water ser- vice suspension--Notice and hearing procedure. A. As an additional and concurrent method of collec- tion of any such delinquent sewerage rate or charge, the customer service manager may suspend the water ser- vice 411 or supply from the premises to which such charge for sewerage has attached until such rates and charges are paid. B. No water service shall be suspended until a written notice has been served upon or mailed to the 11/ customer at least seven days prior to suspending service. Such notice shall state the date on which service is to be suspended, the amount of delinquent sewerage charges and that a customer may request in writing a hearing before the customer service manager or his designee to contest the suspension, provided such request is received by the customer service manager or his designee before the date service is to be suspended. C. Upon timely receipt of a request for hearing the customer service manager or his designee shall conduct a hearing and the customer requesting the hearing shall be notified in writing by the customer service manager or his designee of the time, date and place of such hear- ing. Pending the outcome of a hearing, no service shall 410 be suspended. D. When water service has been suspended for non- payment of a sewer charge, water service shall not be resumed until all delinquent service charges have been paid, together with an additional $5.00 reconnection charge. E. In the event the occupant of a premises is some- one other than the customer, the occupant, or in the case of a multiple dwelling, the manager or person in charge, shall be notified in writing of the date of the suspension of service and the amount of delinquency at the same time such customer is so notified." Section 3. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as pro- vided by law and by the City Charter.
