HomeMy WebLinkAbout1979-2263 REZONE PROPERTY BETWEEN 32ND AND 34TH AVENUES SOUTH OF NOB HILL BOULEVARD. • ORDINANCE NO, AN ORDINANCE accepting the recommendation of the Planning Com- mission and rezoning certain property situated between 32nd and 34th, Avenues south of Nob Hill Boulevard in the City of Yakima, Washington, from 13,2, Local Business Zone, to B-1, Modified Busi- ness Zone, WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 5th day of February, 1979, upon the recommendation of the Planning Commission that real property situated between 32nd and 34th Avenues south of Nob Hill Boulevard in the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from II/ B-2, Local Business Zone, to B-1, Modified Business Zone, and- . WHEREAS, the City Council finds that such recoliduendation of the Planning Commission for such rezoning should be apprOved for the reasons that such rezoning is in accord with good planning and with the General Plan of the City of Yakima; that.the majority of property owners in the vicinity do not oppose the change in classification; that the needs of the City and community do require such change and that the highest and best use of said property is for Modified Business Zone, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situated between 32nd and 34th Avenues south of Nob Hill Boule- vard in the City of Yakima, Washington, and more particularly described as follows, to wit: Lots 1, 2 and 3 of the H. L. Smith Addition, as recorded in Volume "Y" of Plats, page 47, records of Yakima County, Washington, be rezoned from B-2, Local Business Zone, to B-1, Modified Busi- 411 ness Zone, be, and the same is hereby, approved and said real property is hereby rezoned to Modified Business Zone. Section 2. The above change in zoning shall be included 110 and depicted on the next regularly amended Use District Map prepared by and for the City. • • Section 3. The City Clerk is hereby authorized and directed 410 to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect i lk thirty days after its passage, approval and publication as provided by law and by the City Charter.
