HomeMy WebLinkAbout1976-1965 MODIFICATIONS TO PROPERTY ON NORTHEAST CORNER OF SOUTH 40TH AVENUE & WEST NOB HILL BOULEVARD. ORDINANCE NO. MCI AN ORDINANCE granting modifications to a Planned Development Zone for certain property situated on the northeast corner of South 40th Avenue and West Nob Hill Boulevard within the City of Yakima. WHEREAS, by City of Yakima Ordinance No. 1331, enacted August 23, 1973, real property described below was zoned Planned Development Zone, and modifications to the development of that property were authorized by City of Yakima Ordinance No. 1590, enacted December 3, 1973, and Ordinance No. 1662,. enacted May 13, 1974, and WHEREAS, C. D. and Nell Brandt, owners of such property, have requested further modifications to the plan-and program for the development of such property; and the Planning Commission recommended granting such modifications pursuant to its hearing conducted on May 18, 1976, and WHEREAS, the Yakima City Council set a hearing for June 21, • 1976, on the request for such modifications, as a result of which hearing the City Council finds that the recommendation of the Planning Commission should be accepted and that such modifications should be granted so that the development of such property shall conform to the modified final development plan and program attached hereto, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Modifications to the Planned Development Zone of property owned by C. D. and Nell Brandt, situated in the City of Yakima, Yakima County, Washington, and legally described as follows: Parcel A: The North half of the Southwest quarter of the Southwest quarter of the Northeast quarter of Section 27, Township 13 North, Range 18, E.W.M., 1. • EXCEPT the Sputh 110 feet of the East 134 feet thereof, EXCEPT the South 6 feet, EXCEPT the East 25 feet for county road; Parcel B: The North half of the West half of the South- west quarter of the Southwest quarter of the Northeast quarter of Section 27, Township 13 North, Range 18, • E.W.M., EXCEPT the West 40 feet thereof for street; are hereby granted so that the development of said property shall conform to the final development plan and program, as modified, • attached hereto and by reference made a part hereof, subject to the following conditions: 1. That complete landscaping and irrigation plans be submitted to and approved by the Office of Environ- mental Planning prior to issuance of building per- mits. 2. That sign size, design and location be submitted • to and approved by the Office of Environmental Planning prior to issuance of sign permits. 3. That sidewalks be provided according to city stan- dards by the applicant on the east side of 40th Avenue along the entire width of, and adjacent to, applicant's property as an extension of the existing sidewalk on abutting property.- Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4.
