AN ORDINANCE relating to traffic control; regulating parking in
public parking lots operated by the City; repealing
Ordinance No. 1968, enacted June 21, 1976; adopting
Section 9.50.675 as a new section of the City of
Yakima Municipal Code; re-enacting existing Section
111, 9.50.560 of the City of Yakima Municipal Code; and
declaring an emergency.
WHEREAS, Ordinance No. 1968, enacted June 21, 1976, purported
to enact Section 9.50.560, entitled "Public Parking Lots", as a new •
section of the City of Yakima Municipal Code, and
WHEREAS, the reference in Ordinance No. 1968 to Section
9.50.560 is erroneous in that the Yakima City Code contains an exist-
ing Section numbered 9.50.560, entitled "Obedience to Signs or
Markings", which existing section was not intended to be amended or
repealed by Ordinance No. 1968, and
WHEREAS, the City Council desires to repeal Ordinance No. 1968,
Aft but to retain in force and effect the existing Section 9.50.560
entitled "Obedience to Signs or Markings", and the City Council
desires to adopt a new section of the City of Yakima Municipal Code
to be numbered 9.50.675 and entitled "Public Parking Lots", so as
to amend and re-enact regulations for parking in public parking lots
operated by the City, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. City of Yakima Ordinance No. 1968, enacted June 21,
1976, is hereby repealed; provided, this repeal shall not invalidate
or otherwise affect any citation issued, or any impoundment of a
vehicle, pursuant to Ordinance No. 1968 prior to its repeal as pro-
vided by this section.
• III Section 2, Section 9.50.675 is hereby enacted as a new sec-
tion of the City of Yakima Municipal Code to read as follows:
"9.50.675 Public Parking Lots.
A. Parking time limit. In all parking lots operated
by the City for public parking, it shall be unlawful for
any person to park a vehicle for a period of time in excess
of two consecutive hours between the hours of 9:00 a.m.
and 6:00 p.m. on any day except Sundays and public holidays.
B. Method of parking.
(1) In all parking lots operated by the City for
public parking, all vehicles shall be parked so as to be
contained within a designated parking space or stall, and
it shall be unlawful for any person to park a vehicle so
that it occupies or overlaps more than one parking space
or stall as designated by lines or markers.
Any vehicle parked in violation of this Subsection
9.50.675 B in a traffic aisle, at or near an entrance or
exit, or in any other place or manner so as to obstruct or
interfere with the movement of vehicular traffic into, within
or out of any such parking lot is subject to immediate im-
poundment and disposition as provided by Chapter 6.84 of
this code."
Section 3. Existing Section 9.50.560 of the City of Yakima
Municipal Code is hereby re-enacted to read as follows:
"9.50.560 Obedience to signs or markings. Upon
those streets which have been signed or marked for angle
parking, parallel parking or center-street parking, no
person shall park or stand a vehicle in any manner other
than that indicated by such signs or markings nor stand
or park any portion of a vehicle outside the confines of
such markings."
Section 4. This ordinance is one to provide for the immediate
preservation of the public peace, property, health, safety and
welfare of the people of the City of Yakima and an emergency is
hereby declared to exist and this ordinance shall be in full force
and effect immediately upon its passage, approval and publication
as provided by law and by the City Charter.
