AN ORDINANCE relating to public safety and morals; enacting
regulations and prohibitions pertaining to harboring
animals and animals running at large; enacting
requirements pertaining to licensing of dogs; and
amending Sections 6.20.010, 6.20.030 and 6.22.010
• of the City of Yakima Municipal Code.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 6.20.010 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"6.20.010 Animals running at large. It shall be unlaw-
ful for any domestic animal of any kind or any fowl to run
at large, during any hour of the day or night, within the
City of Yakima on any street, alley, sidewalk, way, boulevard,
park, public playground or schoolground, or in any other public
place or building, or on any private property other than that
of the owner or keeper of the animal or fowl. Any animal or
fowl so straying, entering or trespassing upon such property
is declared to be a nuisance subject to immediate impoundment
under the provisions of this chapter."
Section 2. Section 6.20.030 of the City of Yakima Municipal
Code is hereby amended to read as follows:
• "6.20.030 Harboring vicious animals.
A. It is unlawful for any person to keep, harbor or
maintain on or off his premises in a manner liable to endanger
the safety of persons or property lawfully upon said premises,
or upon any public way or place immediately adjoining said
premises, any vicious, menacing or dangerous dog or other
animal.
B. It is the duty of any person who keeps, harbors or
maintains any vicious, menacing or dangerous dog or other
animal to secure such dog or other animal or to secure the
premises where such dog or other animal is kept, harbored
or maintained, so as to prevent such dog or other animal
from wandering onto private property of another, or onto any
street, alley, sidewalk, way, boulevard, park, public play-
ground or schoolground, or any other public place. It shall
be unlawful for any person who keeps, harbors or maintains
any such vicious, menacing or dangerous dog or other animal
to fail to perform the duty imposed by this subsection.
• C. Any vicious, menacing or dangerous dog or other
animal which is kept, harbored or maintained in such a manner
so as to violate Subsection 6.20.030 A of this section, or
which is found on the private property of another or on any
public street, alley, sidewalk, way, boulevard, park, public
playground or scho4lground, or in any other public place
in violation of Subsection 6.20.030 B of this section, is
hereby declared to constitute a public nuisance subject to
immediate impoundment under the provisions of this chapter. 411 Upon the conviction of any person charged with violating
this section, if the court finds any dog or other animal
to be vicious, menacing or dangerous as provided in this
section, then the court may in its discretion order the dog
or other animal to be killed or otherwise disposed of by
the Yakima County Humane Society with the cost thereof to
be taxed and collected in the same manner as other costs
in the case."
Section 3. Section 6.22.010 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"6.22.010 Dog license required. It is unlawful
for any person to own, keep or have control of a dog of
any kind or size over the age of four months in the City
of Yakima without having procured a Yakima city dog license
therefor and without having the license tag hereafter pro-
vided for attached to a collar worn by such dog. In any
prosecution for a violation of this chapter the absence of
the license tag on a dog's collar shall be prima facie evi-
dence that said dog has not been legally licensed." •
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
