ORDINANCE NO. \rill AN ORDINANCE accepting the recommendation of the Planning Commis- sion and rezoning property at the southeast corner of Nob Hill Boulevard and South 48th Avenue from R-1, Single-Family Zone to Planned Development Zone. WHEREAS, after proper petition and due notice, hearings have been held by the Planning Commission and by the City Council of 411 the City of Yakima on the application of Robert W. Yates to rezone property situate at the southeast corner of Nob Hill Boulevard and South 48th Avenue in the City of Yakima, Washington, which property is more particularly described below, from R-1, Single-Family Zone, to Planned Development Zone, and WHEREAS, as a result of its hearing on June 15, 1976, the Plan- ning Commission has recommended approval of such rezone application, and WHEREAS, on July 12, 1976, the City Council held its hearing on such application and as a. result thereof finds that the recom- mendation of the Planning Commission for such rezoning should be approved for the reasons that such rezoning is in accord with good planning and with the General Plan of the City of Yakima; that the • majority of the property owners in the vicinity do not oppose the change in classification; that the needs of the City and community do require such change and that the highest and best use of said property is for Planned Development Zone, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situate at the southeast corner of Nob Hill Boulevard and South 48th Avenue in the City of Yakima, Washington, and more particularly described as follows, to wit: Lot 49, N. A. Medley Oakridge Subdivision No. 2, be rezoned from R-1, Single-Family Zone, to Planned Development Zone be, and the same is hereby, approved; and said real property 410 is hereby rezoned Planned Development Zone all in accordance with, and to conform to, the final development plan and program therefor approved by the Yakima Planning Commission, a copy of which is attached hereto and by reference made a part hereof; provided, the effectiveness of this rezone is subject to the following conditions: 1. An indication of fencing material, including ,fence height and dimensional placement, to be submitted for review and approval by the Principal Planner before its con- struction. 2. Complete and accurate plans for sign placement to be sub- mitted for review and approval by the Principal Planner prior to the issuance of a building permit. 3. Definitive landscaping plan, including plant list and location of plantings, together with a plan for care and maintenance of site improvements, to be submitted for review and approval by the Principal Planner before landscaping is installed. Section 2• The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the City. Section 3, The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as pro- vided by law and by the City Center.
