ORDINANCE NO. \R9,1 AN ORDINANCE accepting the recommendation of the Planning Commis- sion and rezoning property at 3807 West Nob Hill Boulevard in the City of Yakima from B-2, Local Business Zone, to B-3, General Business Zone. • WHEREAS, pursuant to due and legal notice, the • City Council of the City of Yakima held a hearing on the 23rd day of August, 1976, upon the recommendation of the Planning Commission that real property situated at 3807 West Nob Hill Boulevard in the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from B-2, Local Business Zone, to B-3, General Business Zone, and WHEREAS, the City Council finds that such recommendation of the Planning Commission for such rezoning should be approved for the reasons that such rezoning is in accord with good planning and with the General Plan of the City of Yakima; that the majority • of property owners in the vicinity do not oppose the change-in classification; that the needs of the City and community do require such change and that the highest and best use of said property is for General Business Zone, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situated at 3807 West Nob Hill Boulevard in the City of Yakima, Washington, and more particularly described as follows, to wit: The South six feet of the northeast quarter of the south- west quarter of the southwest quarter of the northeast quarter and all of the southeast quarter of the southwest quarter of the southwest quarter of the northeast quarter of 41/ Section 27, Township 13 North, Range 18, E.W.M.; EXCEPT THE FOLLOWING: (1) the east 149.2 feet of the south 237.8 feet thereof; (2) the east 30 feet for road and road right-of-way on the south; and (3) a strip of land six feet in width adjoining said south road on the north side thereof conveyed to Yakima Valley Transportation Co. by deed recorded in Volume 90 of Deeds, page 473, records of Yakima County, Washington, be rezoned from B-2, Local Business Zone, to B-3, General Business Zone, be, and the same is hereby, approved and said real property is hereby rezoned to General Business Zone. Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed III to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
