AN ORDINANCE providing for the vacation of a public alley in the
City of Yakima, Washington.
WHEREAS, a petition has been filed with the City Council of
110 the City of Yakima requesting the vacation of the hereinafter des
cribed public alley, and
WHEREAS, a hearing by the City Council was duly held on said
petition, and as a result of such hearing the City Council finds
it to be in the best interests of the City of Yakima that said petition
be granted and that said alley be vacated, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The following described alley in the City of Yakima,
Washington, to wit:
The Alley in Block 66, according to the plat of the Town
of North Yakima, now Yakima, recorded in Volume "E" of
Plats, page 1, records of Yakima County, Washington, between
the North right-of-way line of "D" Street and the south
right-of-way line of "E" Street,
be, and the same is hereby, vacated.
Section 2. The City of Yakima hereby reserves all necessary
easements and rights of way for the installation and maintenance of
any and all water mains, sewers or utilities of any and all kinds
which may now exist in said alley or which it may, hereafter desire
to construct therein, and no building or other structure shall be
constructed on any portion of said vacated alley without the prior
approval of the City.
Section 3. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter; provided, this ordinance shall not
become effective until the owners of property abutting upon that por-
tion of the vacated alley above described shall compensate the City
in the amount of $8,960, that amount being one-half the appraised
value of the area vacated by this ordinance.
PASSED BY THE CITY COUNCIL, signed and approved this \'3 day
