AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning property at South 10th Avenue between West
Spruce and Walnut Streets from R-3, Multiple Family Zone,
to B-1, Modified Business Zone.
• WHEREAS, pursuant to due and legal notice, the City Council of
the City of Yakima held a hearing on the 4th day of October, 1976, upon
the recommendation of the Planning Commission that real property situated
at South 10th Avenue between West Spruce and Walnut Streets in the City
of Yakima, Washington, the legal description of which is set out here-
inbelow, be rezoned from R-3, Multiple Family Zone, to B-1, Modified
Business Zone, and
WHEREAS, the City Council finds that such recommendation of the
Planning Commission for such rezoning should be approved for the reasons
that such rezoning is in accord with good planning and with the General
Plan of the City of Yakima; that the majority of property owners in
the vicinity do not oppose the change in classification; that the needs
of the City and community do require such change and that the highest
and best use of said property is for Modified Business Zone, now, there-
fore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The 'recommendation of the Planning Commission of the
City of Yakima that the following described real property situated at
South 10th Avenue between West Spruce and Walnut Streets in the City of
Yakima, Washington, and more particularly described as follows, to wit:
Lots 1, 2, 3, 4, 5, 6, 7 and 8, Block 393 of Capitol Addition
to North Yakima recorded in Volume A, page 29, of Plats, records
of Yakima County, Washington,
be rezoned from R-3, Multiple Family Zone, to B-1, Modified Business
Zone, be, and the same is hereby, approved and said real property is
hereby rezoned to Modified Business Zone.
Section 2. The above change in zoning shall be included and depic-
ted on the next regularly amended Use District Map prepared by and for
the City.
Section 3. The City Clerk is hereby authorized and directed to
file with the Yakima County Auditor a certified copy of this ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided 410
by law and by the City Charter.
