AN ORDINANCE relating to city government administration; and
relating to the appointment and duties of the Human
Relations Commission and a Community Relations Offi-
cer; amending Sections 1.18.010, 1.30.010 and 1.30.040,
410 and enacting Section 1.30.050 as a new section, all
of the City of Yakima Municipal Code.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 1.18.010 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"1.18.010 City Manager--Powers and duties. The city
manager shall be the chief executive officer and the head
of the administrative branch of the city government. He
shall be responsible to the council for the proper adminis-
tration of all administrative affairs of the city and
to that end he shall have power and shall be required to:
(1) Plan, direct and coordinate the administrative
functions of the city and administer and execute the laws
and ordinances of the city;
(2) Appoint and, when necessary for the good of the
• service, remove all administrative officers and employees
of the city, all in compliance with civil service rules,
regulations and laws; he may authorize the head of the
department or office to appoint and remove subordinates
in such department or office; provided, appointment to
the position of community relations officer shall be made
by a majority vote of the city council as provided by Sec-
tion 1.30.050 of this code and as authorized by Article
II, Section 6, of the Yakima City Charter;
(3) Prepare the budget annually and submit it to
the council and be responsible for its administration
after adoption;
(4) Prepare and submit to the council as of the end
of the fiscal year a complete report of the finances and
administrative activities of the city for the preceding
year;
(5) Keep the council advised of the financial condi-
tionand future needs of the city and make such recommenda-
tions as may seem to him desirable;
(6) Administer all finance and,fiscal matters of the
city and countersign all warrants and approve all claim
vouchers and authorize all travel for administrative per-
sonnel;
(7) Perform such other duties as may be prescribea
by this chapter or required of him by the council, not
inconsistent with the Charter;

(8) Prepare and submit to the council such reports
• as may be required by that body or he may deem it advisable
to submit; the manager may have one confidential secretary,
• and if the volume of business justifies it he may have
an administrative assistant;
(9) Transfer between items within any class in the
budget, and, notwithstanding the provisions of any statute
to the contrary, the budgetary transfers herein authorized
may be made as between any offices, departments, divisions,
services, institutions, etc., or any combination thereof
within the city's organizational structure, which operate
from the appropriations of the same fund; provided, however,
that no salary shall be increased above the amount provided
therefor in the budget."
Section 2. Section 1.30.010 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"1.30.010 Human Relations Commission created--Members.
There is hereby created a Human Relations Commission of the
City of Yakima to consist of eleven members of various racial,
religious and ethnic backgrounds and who shall be represen-
tative of the citizens of Yakima as to age, sex and economic
status, who shall serve without compensation. The Community
Relations Officer of the City of Yakima shall be an ex officio
member and deputy to the commission, but shall not be entitled
to vote on any matter voted on by the commission."
Section 3. Section 1.30.040 of the City of Yakima Municipal
Code is hereby amended to read as follows:
• "1.30.040 Duties. • The duties of the commission
shall be to:
1. Conduct public education programs and solicit
the cooperation of individuals and organiza-
tions in the City in promoting equality and
understanding among all citizens on matters
involving discrimination because of race, creed,
f -color, national origin, age, sex, religion,
• marital status or handicap;
2. Investigate problems arising in the City which
may result in tensions or discrimination because
of race, creed, color, national origin, age,
sex, religion, marital status or handicap; and
perform persuasion, mediation or conciliation
services where deemed appropriate by the com-
mission to reduce tensions and discrimination • 411
in the community;
• 3. • Conduct hearings, in accordance with rules and
regulations adopted and approved pursuant to
Subsection 1.30.030 C of this chapter, on all
complaints referred to it by the City Community
Relations Officer involving a charge of dis-
crimination by any City department, or City
employee in the discharge of that employee's
• duties, because of race, creed, color, national

origin, age, sex, religion, marital status or
handicap; and after such hearing, make a written
report to the City Council containing findings
of fact concerning the complaint and a recom-
mendation to the City Council for the resolution
of the complaint;

4. Report to the City Council on investigations
conducted by the commission and make recommen-
dations designed to eliminate prejudice and
discrimination and to improve understanding
of human relations in the community;
5. Periodically review and monitor the City's
Affirmative Action Program; and
6. Perform other assignments as may be requested
by the City Council."
Section 4. Section 1.30.050 is hereby enacted as a new section
of the City of Yakima Municipal Code to read as follows:
"1.30.050 Community Relations Officer.
A. The office of Community Relations Officer is
hereby established as an employee of the City Council,
as authorized by Article II, Section 6, of the Yakima
City Charter, who shall be appointed by a majority vote
of the City Council,
B. Under the supervision of the City Council, the
Community Relations Officer shall perform duties and
functions generally described as follows:
1. Serve as deputy to the Human Relations Commis-
sion by performing staff functions as determined
from time to time by the City Council.
2. Conduct educational programs ,in the community
to promote equal treatment, equal _opportunity
and understanding among persons and groups of
different rpces, religions and national origin;
and anticipate problems which may arise in the
City which may result in tensions or discrimination
and propose solutions to improve community rela-
tions, including mediation and conciliation ser-
vices.
3. Promote improved relations within City govern-
• ment and throughout the community on matters
involving racial, religious, ethnic, sex or
age discrimination; and meet with citizen groups
to maintain liaison between the community and
City government concerning matters involving
discrimination and other government related
problems.
4. Receive citizen inquiries or complaints regard
ing municipal services, investigate such inquiries
and complaints, and mediate unresolved complaints

between citizens and the City government,
including complaints of any act or practice
of discrimination on account of race, religion,
ethnic origin, sex or age.
5. Perform administrative research and other work
as assigned by the City Council and submit
reports and recommendations to the Council

for changes in administrative procedure and
legislative policy, and for the Council's
general information.
6. Continuously monitor and audit the City's
Affirmative Action Program.
7. Routinely apprise the Council on activities
and findings of the Community Relations Office,
8. Perform such other related duties and functions
as assigned by the City Council from time to
time."
Section 5. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
