ORDINANCE NO. r,,L9Do\c) AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning property at South 1st Avenue and Peach Street from R-2, Two Family Zone, to M-1, Light Industrial Zone. WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 18th day of October, 1976, upon the recommendation of the Planning Commission that real property situated at South 1st Avenue and Peach Street in the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R-2, Two Family Zone, to M-1, Light Industrial Zone, and WHEREAS, the City Council finds that such recommendation of the Planning Commission for such rezoning should be approved for the reasons that such rezoning is in accord with good planning and with the General Plan of the City of Yakima; that the majority of property owners in the vicinity do not oppose the change in classification; that the 410 needs of the City and community do require such change and that the highest and best use of said property is for Light Industrial Zone, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situated at South 1st Avenue and Peach Street in the City of Yakima, Washington, and more particularly described as follows, to wit: Beginning at a point on the south line of the northwest quarter of the northwest quarter of Section 30, Township 13 North, Range 19, E.W.M., 914 feet east of the southwest corner of said sub- division; thence northwesterly 731.95 feet to a point that is 605.3 feet east and 663.65 feet north of the southwest corner of said subdivision, said point being on the east right-of-way line of South First Avenue according to the plat of DeAtley Park Addition recorded in Volume "L" of plats, page 8, records of Yakima County, Washington; thence northerly along said right- of-way line to the centerline of Peach Street as shown on said plat; thence westerly along the centerline of Peach Street to the west line of the northwest quarter of the northwest quarter of Section 30; thence northerly to the northwest corner of said subdivision; thence easterly along the north line of said sub- division to an intersection with a line that is parallel with and 160 feet westerly of the centerline of the main line of the Union Pacific Railroad when measured at right angles; thence southeasterly along said line to an intersecrion with the south line of the northwest quarter of the northwest quarter of Sec- tion 30; thence westerly along said south line to the point of beginning, 411/ be rezoned from R-2, Two Family Zone, to M-1, Light Industrial Zone, be, and the same is hereby, approved and said real property is hereby rezoned to Light Industrial Zone. Section 2. The above change in zoning shall be included and depicted on the next regularly ameaded Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter. • PASSED BY THE CITY COUNCIL, signed and approved this . a . t .
