Q0,-, AN ORDINANCE relating to funds and accounts; reestablishing the Bicen- tennial Pavilion Construction Fund as a special fund and designating the sources of revenue to such fund; All specifying purposes of expenditures and means of authoriz- ing expenditures from such fund; amending Section 3.93.040 and repealing Section 3.93.050, both of the City of Yakima Municipal Code; and declaring an emergency. BE IT ORDAINED BY THE. CITY OF YAKIMA: Section 1. Section 3.93.040 of the City of Yakima Municipal Code is hereby amended to read as follows: "3.93.040 Bicentennial Pavilion Construction Fund, A. Fund created. There is created a special fund to be known as the Bicentennial Pavilion Construction Fund. B. Sources of funds. All proceeds of the special excise tax imposed by this chapter and all revenue paid to the City by the County of Yakima as proceeds from the special tax im- posed by the County of Yakima pursuant to R.C.W. 67.28.180 (prior to its amendment by Chapter 225, Section 1, Laws of 1975, 1st Extraordinary Session), shall be deposited in the 411 Bicentennial Pavilion Construction Fund, together with funds from other sources as may be determined from time to time by the Yakima City Council. C. Purpose--Expenditures. Expenditures from the Bicen- tennial Pavilion Construction Fund shall be made only for the purposes of paying all or any part of the cost of acquir- ing, constructing or operating stadium facilities and/or convention center facilities, including but not limited to buildings, structures, concession and service facilities, roads, walks, ramps and other access facilities, terminal and parking facilities for private vehicles and public transportation vehicles and systems, together with all lands, properties, property rights, equipment, utilities, accessories and appurtenances necessary for such public stadium facilities and/or convention center facilities, and to pay for any engineering, planning, financial, legal and professional services incident to the development and operation of such public stadium facilities and/or conven- tion center facilities; and to pay or secure the payment of all or any portion of General Obligation Bonds or revenue bonds issued for such purpose or for purposes under Chapter 67.28 of the Revised Code of Washington. No expenditure 110 shall be made from such fund unless the City Council shall approve such expenditure by passing an ordinance appropriating money within the fund for the purpose for which the expenditure is to be made or by including an appropriation for such pur- pose in the budget." Section 2. Section 3.93.050 of the City of Yakima Municipal Code is hereby repealed. Section 3. This ordinance is one to provide for the immediate preservation of the public peace, property, health, safety and wel- fare of the people of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
