AN ORDINANCE accepting the recommendation of the Planning Commission 1
and rezoning property situated south of Nob Hill Boule-
vard on the east side of South 22nd Avenue in the City 1
of Yakima from R-2, Two Family Zone, to B-3, General 1
Business Zone.
410 WHEREAS, pursuant to due and legal notice, the City Council of
the City of Yakima held a hearing on the 31st day of January, 1977,
upon the recommendation of the Planning Commission that real property
situated on the east side of South 22nd Avenue south of Nob Hill
Boulevard in the City of Yakima, Washington, the legal description
of which is set out hereinbelow, be rezoned from R-2, Two Family Zone,
to B-3, General Business Zone, and
WHEREAS, the City Council finds that such recommendation of the
Planning Commission for such rezoning should be approved for the reasons
that such rezoning is in accord with good planning and with the General
Plan of the City of Yakima; that the majority of property owners in
410 the vicinity do not oppose the change in classification; that the needs
of the City and community do require such change and that the highest
and best use of said property is for General Business Zone, now,
therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1,. The recommendation of the Planning Commission of the
City of Yakima that the following described real property situated
south of Nob Hill Boulevard on. the east side of South 22nd Avenue in
the City of Yakima, Washington, and more particularly described as
follows, to wit:
Lot 39, French's Addition, Subdivision, as recorded in Volume
I of Plats, page 13, records of Yakima County, Washington,
be rezoned from R-2, Two Family Zone, to B-3, General Business Zone,
be, and the same is hereby, approved and said real property is hereby
rezoned to General Business Zone; provided, this rezone is granted on
the condition that plans for installing landscaping and erecting a
site screening fence along the easterly and southerly property lines
of the above described property be submitted to the Principal Planner
of the City of Yakima for his discretionary approval prior to the
issuance of a building permit for improvement to that property,
and subject to the further condition that such landscaping and
site screening fence, as approved by the Principal Planner, shall
be installed prior to any use being made of that property for busi-
ness purposes.
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared by
and for the City.
Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this
ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
