AN ORDINANCE of the City Council of the City of
Yakima, Washington, providing for the approval
of the plans and specifications for off-street
parking and other improvements within Local
Improvement District No. 1001 of the city,
exclusive of that portion of such improve-
./ ments generally known as the Mall Parking
Garage.
WHEREAS, the City Council has heretofore adopted its Ordinances
1719 forming a Parking and Business Improvement Area (the "PBIA")
and 1720 folluing Local Improvement District No. 1001 ("L.I.D. 1001")
authorizing the acquisition, construction and installation of
certain off-street parking facilities, improvements to pedestrian
spaces and general improvements to the central business district
of the city (which improvements are herein sometimes called the
"Project"); and
WHEREAS, said Ordinances 1719 and 1720 approved certain
preliminary plans and specifications for such improvements; and
• WHEREAS, final plans and specifications for such improve-
ments have now been prepared and are on file with the city; and
WHEREAS, the City Council has considered, pursuant to a
public hearing held on March 21, 1977, the feasibility of acquiring
that portion of the Project generally known as the Mall Parking
Garage and has heard statements from various interested citizens,
property owners and city staff concerning the desirability and
feasibility of acquiring the Mall Parking Garage; and
WHEREAS, the City Council has considered whether or not any
environmental impact will occur as a consequence of the acquisition
or non-acquisition of the Mall Parking Garage by the city;
NOW, THEREFORE, BE IT ORDAINED by the City of Yakima, Wash-
ington, as follows:
Section 1. The Council of the City of Yakima does hereby
find and declare the following:
(1) By reason of the unwillingness of the title holder of .
the Mall Parking Garage to convey such property to the city and
the legal inability of the City of Yakima to acquire such facility
through the exercise of the power of eminent domain it is now
111 wholly unfeasible, either legally or practically, for the City of
Yakima to acquire the Mall Parking Garage as a part of the facili-
ties to be financed by L.I.D. No. 1001 or the PBIA.
(2) A determination not to acquire the Mall Parking Garage
is not an "action" as defined by WAC 197-10-040(2) or the State
Environmental Policy Act.
(3) Such non-acquisition will have no significant environ-
mental impact.
(4) A decision not to acquire the Mall Parking Garage as a
part of the Project is not a change in the Project which makes
necessary the preparation, consideration or circulation of a new
or revised environmental impact statement.
• Section 2. The final plans and specifications for the
Project now on file with the City are hereby approved, provided,
however, that the Mall Parking Garage shall be deleted from those
facilities and improvements, comprising the Project, to be acquired
and constructed as a part of and within L.I.D. No. 1001 and the
PBIA. Such plans and specifications are subject to such changes
as to the details thereof as may hereafter be approved by resolution
of the City Council.
Section 3. Ordinances 1719 and 1720 shall be deemed amended
to the extent that they are inconsistent with the provisions of
this ordinance.
Section 4. This ordinance shall be in full force and effect
thirty -.days after its passage, approval and publication as provided
by law and by the city charter. •
