HomeMy WebLinkAbout1977-2064 CONSTRUCTING A PIPE SEWER WITH WYE BRANCES, MANHOLES, AND FLUSH ENDS; ESTABLISHING A CERTAIN LOCAL IMPROVEMENT • ORDINANCE NO. AN ORDINANCE providing for the improvement of certain property by constructing a pipe sewer with the necessary wye branches, manholes and flush ends; establishing a Local Improvement District, providing for the Ilk method of payment thereof, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The following described property situate in Yakima County, Washington, shall be improved by constructing a pipe sewer with the necessary wye branches, manholes and flush ends: Beginning at the northwest corner of Lot 5, Fruitvale, as recorded in Volume "A" of Plats, Page 20; thence south along the west line of Lots 5 and 20 and said west line extended, to the northerly right-of-way line of the Nor- thern Pacific Railroad; thence easterly to the intersec- tion of said right-of-way line and the centerline of 20th Avenue (Wright Avenue); thence south along said centerline to a point east of the northwest corner of Rohrich's Plat, as recorded in Volume "L" of Plats, Page 14; thence east 41/ along the north line of said plat to the northwest corner of Lot 5; thence south along the west line of said Lot 5 to the southwest corner thereof; thence east to a point which is 102.40 feet east of the west line of Lot 10, J. H. Hathaway's Five Acre Tracts, as recorded in Volume "A" of Plats, Page 26, said point being the southeast corner of that certain tract of land conveyed by instrument recorded June 20, 1972, under Auditor's File No. 2286488; thence north along the east line of said tract to the northeast corner thereof; thence east to a point which is 66 feet east of the west line of Lot 12 of said J. H. Hathaway's Five Acre Tracts, said point being the southeast corner of •that certain tract of land conveyed by instrument recorded • March 27, 1970, under Auditor's File No. 2216972; thence north to the south right-of-way line of the Northern Pacific Railroad right-of-way; thence west along said right-of-way line to a point on the east line extended of Lot 7 of said J. H. Hathaway's Five Acre Tracts; thence north along the east line of said Lot 7 to the northeast corner thereof; thence west to a point which is 601.6 feet, more or less, east of the southwest corner of the northwest quarter of the northwest quarter of Section 13, Township 13 North, 111 Range 18, E.W.M.; thence north 1093 feet, more or less; thence west 182.6 feet, more or less; thence south 155 feet, more or less; thence west to the west line of North 16th Avenue as it existed on September 21, 1976; thence northerly along said right-of-way line to the southerly right-of-way line of S.R. 12 as it existed on September 21, 1976; thence along said right-of-way line to the west line of the south- east quarter of the southeast quarter of the southeast quar- ter of Section 11, Township 13 North, Range 18, E.W.M.; thence south along said west line and the west line of Lot 12, Fruitvale, as recorded in Volume "A" of Plats, Page 20, to an intersection with the following described line: Commencing at the northeast corner of Section 14, Township 13 North, Range 18, E.W.M.; thence south Reference Meridian along the east line thereof 158.15 feet to the point of beginning; thence south 110 64 west 268.50 feet; thence south 61 west 223.50 feet; thence south 68 west 367.80 feet; thence north 89 west 540.20 feet; thence north 89 west to the west line of Lot 10, Fruitvale, as recorded in Volume "A" of Plats, Page 20, and the terminus of said line; thence along said above described line to its terminus; thence north to the northeast corner of Lot 9, of said Plat; thence westerly to the northwest corner of Lot 5 of said Plat and the point of beginning. Section 2. There is hereby created a Local Improvement Dis- trict, to be called "Local Improvement District No. 1011," which said district shall include all of the above described property. Section 3. The assessments shall be made according to special benefits derived from the improvements without regard to 411 the zone and termini method. Section 4. All costs and expenses in connection with the construction of said improvement, including the engineering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefor as provided by law and as above described. Section 5. All of the aforesaid construction work shall be in accordance with the plans and specifications, profiles, maps and detailed drawings which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted. Section 6. The work necessary to be done in connection with the making of said improvement shall be done by contract upon com- petitive bids according to specifications and plans as prepared by the Engineering Division of the Department of Public Works, and the City shall have the power to reject any and all bids. • Section 7. There is hereby created a special fund, to be called "Local Improvement Fund, District No. 1011," into which shall be placed all sums paid on account of the aforesaid special go : assessments, including all interest and penalties thereon, and in the event of the sale of local improvement bonds by the City, all premium and interest on said bonds issued for said improvement. Section 8. Bonds bearing interest at a rate not to exceed 8% per annum, payable on or before 12 years from the date of issuance, shall be issued in payment of the costs and expense of said improvement, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in ten equal annual installments with interest at a rate not to exceed 81/21 per annum, interest pay- able annually under the mode of payment "payment by bonds'', as • defined by the statutes of the State of Washington and the ordi- nances of the City of Yakima, provided that, this improvement may be financed by the issuance of promissory notes, under the authority of R.C.W. 35.45.150 and Section 8.12.100 of the City of Yakima Municipal Code, Section 9. This ordinance is one relating to local improve- ments or assessments therefor, and shall become effective immediately - - upon its passage, approval and publication as provided by law and by the City Charter.
