'ao'73 AN ORDINANCE relating to public safety and morals; defining and pro- hibiting the operation of body studios and model studios, and prohibiting employment in or patronizing such studios; declaring body studios and model studios to be public nuisances and •providing for their abatement; enacting Sections 6.04.390 and 6.04.392 as new sections of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 6.04.390 is hereby enacted as a new section of the City of Yakima Municipal Code to read as follows: "6.04.390 Body Studios and Model Studios Prohibited. A. Definitions: As used in this section, the following words and phrases shall have the following respective meanings ascribed to them: 1. 'Body Studio'meansany premises upon which is furnished for a fee or charge or other consideration the oppor- tunity to paint, massage, feel, handle, or touch the unclothed body or an unclothed portion of the body of another person, or to be so painted, massaged, felt, handled or touched by another person, or to • observe, view or photograph any such activity, and shall include any such premises which is advertised or represented in any manner whatsoever as a 'body painting studio', 'model studio', 'sensitivity aware- ness studio' or any other expression or characteriza- tion which conveys the same or similar meaning and • which leads to the reasonable belief that there will be furnished on any such premises for a fee or charge or other consideration the opportunity to paint, massage, feel, handle, or touch the un- clothed body or an unclothed portion of the body of another person, or to be so painted, massaged, felt, handled or touched by another person, or to observe, view or photograph any such activity. Provided, 'body studio' as defined herein shall not include massage businesses defined and regulated •by Chapter 18.108 of the Revised Code of Washington, reducing salons or any studio which functions as a part of and under the direct supervision of an institution, the curriculum for which institution is approved by the Office of the State Superinten- dent of Public Instruction of the State of Washing- ton. 2. 'Model Studio' means any premises where the primary purpose of the business is the furnishing of per- sons as models for a fee or charge or other con- sideration for the purpose of being sketched, painted, drawn, sculptured, photographed, or otherwise depic- ted in such a manner or under circumstances which constitute lewd conduct as defined and prohibited by Section 6.04.375 of this chapter. . • • Provided, 'model studio' as defined herein shall not include any studio which functions as a part of and under the direct supervision of an insti- tution, the curriculum for which institution is ' approved by the Office of the State Superinten- dent of Public Instruction of the State of Washing- !" ton, or which functions to provide models who are sketched, painted, drawn, sculptured, photo- graphed or otherwise depicted for the purpose of commercial sale or advertising. . . . _ B. Unlawful Conduct. • • (1) It shall be unlawful for any person, :firm or corpora- tion to operate, conduct or maintain a body studio or model studio as defined in. Subsection A of this section. • (2) It shall be unlawful for any person to be an employee of a body studio or model studio, as defined in Subsection A of this section. (3) It shall be unlawful for any person, on the premises • of a body studio or model studio, to paint, massage, feel, handle, or touch the unclothed body or an unclothed portion • of the body of another person, or to be so painted, massaged, felt, handled or touched by another person, or to observe, • view or photograph any such activity, or to engage in any such activity for the purpose of being.observed, viewed or photographed. C. Separate Offenses. • (1) Each day of operating, conducting or maintaining a body. studio or model studio in violation of Subsection B (1) of this section shall constitute a separate offense. (2) Each day on which any person is an employee of . a body studio or model studio in violation of Subsection B (2) of this section shall constitute a separate offense. (3) Each incident of unlawful conduct prohibited by Subsection B (3) of this section shall constitute a separate ' offense." Section 2. Section 6.04.392 is hereby enacted as a new section of the City of Yakima Municipal Code to read as follows: 1 '6.04.392 'Body Studios' Declared a Public Nuisance. Any use of property within the City of Yakima as a 'body studio' or 'model studio' as defined by Section 6.04.390 of this chapter is a public nuisance, subject to prevention or abatement by injunction or other appropriate legal remedy in the Superior Court of the State of Washington in and for Yakima County." • • • • • -2- • Section 3. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
