AN ORDINANCE relating to licenses and business regulations; specifying qualifications for a city taxicab driver's license; pro- viding for the review by the City Council of the denial 410 or revocation of "for hire vehicle" licenses and taxicab driver's licenses; and amending Section 5.78.190 and enacting new Section 5.78.245, both of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 5.78.190 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.78.190 City driver's license--Qualifications. Each appli cant for a city driver's license provided for in this chapter shall: 1. Be at least twenty-one years of age. 2. Be duly licensed to operate a motor vehicle for hire under the laws of the state of Washington. 3. Submit with the application a certification from a medi- cal doctor, or the Yakima County Health District, certify- 411 ing that applicant is free from any infirmities of body or mind likely to render him unfit to drive a for-hire vehicle, and specifically that applicant is free from epilepsy, vertigo or heart trouble. 4. Not have been convicted, within ten years preceding the time of making the application, of committing any felony directly related to the applicant's ability to drive a motor vehicle for hire; not have been convicted of any violation, other than for a felony, of any law reason- ably related to the applicant's ability to drive a motor vehicle for hire. 5. Demonstrate to the satisfaction of the chief of police applicant's ability to operate and control a for-hire vehicle and his familiarity with traffic regulations." Section 2. Section 5.78.245 is hereby enacted as a new section of the City of Yakima Municipal Code to read as follows: "5.78.245 Review of license denial or revocation. Any applicant who feels aggrieved by the denial of a license for 410 which application is made pursuant to this chapter, and any license holder who feels aggrieved by the City Manager's revo- cation of a license pursuant to Section 5.78.240 of this chap- ter, may appeal that denial or revocation to the City Council by serving on the Yakima City Clerk a notice of such appeal within five days from the date of the denial or revocation from which the appeal is taken, which notice shall be in writing and shall specify all the grounds relied on by the appellant as reasons for the issuance or reissuance, as:the case may be, of the license which was denied or revoked. After the timely filing of such a notice, the City Council shall set a time and place for a hearing thereon by the City Council, after which hearing the City Council shall make a final determination on the matter of the denial, revocation, issuance or reissuance of the license." Section 3. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the city charter.
