AN ORDINANCE. creating Irrigation Maintenance District No. 098; amend-
ing Section 2 of City of Yakima Ordinance No. 2077
• enacted June 13, 1977; and declaring an emergency.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 2 of City of Yakima Ordinance No. 2077,
enacted June 13, 1977, and entitled "AN ORDINANCE accepting the
conveyance to the City of Yakima of an irrigation system serving
Larson's Lots Addition to the City of Yakima, Larson's Lots No. 2
Addition to the City of Yakima, and adjacent property; and accepting
the transfer to the City of rights to receive delivery of and dis-
tribute irrigation water through that system; creating Irrigation
Maintenance District No. 997; setting a public hearing to assess
property within that Irrigation Maintenance District and providing
for the levy and collection of assessments; and declaring an emer
gency," is hereby amended to read as follows:
"Section 2. Irrigation Maintenance District No. 098
is hereby created to consist of all the lots and parcels
of real estate constituting Larson's Lots Addition to the
City of Yakima, recorded in Volume S of Plats, page 30,
records of Yakima County, Washington, and all lots (except
Lots No. 8 and 9) in Larson's Lots No. 2 Addition to the
City of Yakima, recorded in Volume T of Plats, page 16, records
of Yakima County, Washington, together with the following
described parcel situate in the City of Yakima, Yakima County,
Washington, to wit:
The east 64.5 feet of the west 397.5 feet of the
north 141 feet of the south 171 feet of the south-
west quarter of the southwest quarter of Section
15, Township 13 North, Range 18, E.W.M. (4609 Engle-
wood Avenue),
which district shall be administered by the City for the
operation, maintenance and repair of the irrigation water
system conveyed to the City by the transfer document attached
hereto, including the receipt and delivery of irrigation
water through such system, all as contemplated by the trans-
fer document attached hereto and all pursuant to and in
accordance with Chapter 7.24 of the City of Yakima Municipal
Code and Chapter 35.92 of the Revised Code of Washington."
Section 2. This ordinance is one to provide for the immediate
preservation of the public peace, property, health, safety and
welfare of the people of the City of Yakima and an emergency is
hereby declared to exist and this ordinance shall be in full force
and effect immediately upon its passage, approval and publication
as provided by law and by the City Charter.
