ORDINANCE NO. a el/ • AN ORDINANCE relating to zoning; specifying public and private swimming pools as permitted uses in R -1, Single Family Zone, and adopting use regulations concerning the fencing of swimming pool areas; and amending Sub - section 12.12.010 (o) of the City of Yakima Munici- pal Code, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Subsection 12.12.010 (o) of the City of Yakima Municipal Code is hereby amended to read as follows: "12.12.010 Use regulations. In an R- 1 no build- ing shall be erected, reconstructed or structurally altered, nor shall any building or land be used for any purpose except as hereinafter specifically provided and allowed by this chapter, subject to the provisions of Chapter 12.60 govern- ing offstreet parking requirements. In an R -1 Zone the following uses only are permitted: (0) Swimming Pools, provided the following require- ments are met: 1. Public swimming and wading pools capable of hold - ing eighteen inches or more of water shall have the area in which the pool is located surrounded by an enclosure or fence not less than six feet above the underlying ground level. No fence or building shall be located within five feet of the edge of the pool. Gates leading to such public swimming and wading pools shall be securely fastened shut when not in use or supervised by a qualified attendant. Locks or latches shall be placed not less than four feet above the adjacent ground level. 2. Private swimming pools or wading pools capable of holding eighteen inches of water shall have the area in which the pool is located surrounded by an enclosure or fence not less than three feet and six inches above the underlying ground level. No fence or building shall be located within three feet of the edge of the pool. Gates leading to-such private swimming or wading pools shall be provided with safety latches operated from the pool side of the fence and the latch shall be located not less than three feet above the adjacent ground level." Section 2, This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
