AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning property at 10th and "A" Streets from R-3,
Multiple Family Zone, to B-3, General Business Zone.
WHEREAS, pursuant to due and legal notice, the City Council of

the City of Yakima held a hearing on the 8th day of August, 1977, upon
the recommendation of the Planning Commission that real property
situated on the east side of the intersection of 10th and "A" Streets
in the City of Yakima, Washington, the legal description of which is
set out hereinbelow, be rezoned from R-3, Multiple Family Zone, to
B-3, General Business Zone, and
WHEREAS, the City Council finds that such recommendation of the
Planning Commission for such rezoning should be approved for the reasons
that such rezoning is in accord with good planning and with the General
Plan of the City of Yakima; that the majority of property owners in the
vicinity do not oppose the change in classification; that the needs of
III the City and community do require such change and that the highest and
best use of said property is for General Business Zone, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of the
City of Yakima that the following described real property situated at
10th and "A" Streets in the City of Yakima, Washington, and more par-
ticularly described as follows, to wit:
South half of the following described land, to wit:
North 208.725 feet of the west 208.725 feet of the northeast
quarter of the northeast quarter of Section 19, Township 13
North, Range 19, E.W.M., except roads along the north and
west sides thereof, situate in the City of Yakima, Yakima
County, Washington,
111 be rezoned from R-3, Multiple Family Zone, to B-3, General Business
Zone, be, and the same is hereby, approved and said real property is
hereby rezoned to General Business Zone, subject to the following con-
ditions:
1. That chain link fencing be erected along the north and
east property lines of the rezoned area, and that the
fencing be provided with redwood colored aluminum
slats so as to provide site screening.
2. That no barb wire be installed on the chain link
fence to be installed in accordance with condition 110
number 1, above.
3. Along the easterly boundary, the property within
the rezoned area shall be sloped away from the property
line at a grade no more steep than a forty-five degree
angle.
Section 2. The above change in zoning shall be included
depicted on the next regularly amended Use District Map prepared
by and for the City.
Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this
ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided •
by law and by the City Charter.
