AN ORDINANCE accepting the recommendation of the Planning Commis-
sion and rezoning property at North 32nd and Englewood
Avenues from R -1, Single Family Zone, to Planned
Development Zone.
• WHEREAS, pursuant to due and legal notice, the City Council of
the City of Yakima held a hearing on the 6th day of September, 1977,
upon the recommendation of the Planning Commission that real property
situated at North 32nd and Englewood Avenues in the City of Yakima,
Washington, the legal description of which is set out hereinbelow,
be rezoned from R -1, Single Family Zone, to Planned Development
Zone, and
WHEREAS, the City Council finds that such recommendation of
the Planning Commission for such rezoning should be approved for
the reasons that such rezoning is in accord with good planning and
with the General Plan of the City of Yakima; that the majority of
• property owners in the vicinity do not oppose the change in classi-
fication; that the needs of the City and community do require such
change and that the highest and best use of said property is for
Planned Development Zone, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of
the City of Yakima that the following described real property
situated at North 32nd and Englewood Avenues in the City of Yakima,
Washington, and more particularly described as follows, to wit:
PARCEL A:
That portion of the northwest quarter of the northwest quar-
ter of the northwest quarter of Section 23, Township 13
North, Range 18, E.W.M., described as follows:
• Beginning at the northeast corner of said subdivision; thence
south 6 feet west along the east line of said subdivision
540.3 feet; thence north 89 ° 20' west 279.3 feet; thence north
437 feet more or less to the southerly line of the right -of -way
of Naches and Cowiche Ditch Company's canal; thence northwesterly
along the southerly line of said right -of -way to an intersection
with the north line of said Section 23; thence south 89 ° 10'
east along the north line of said Section 23 427.9 feet more
or less to the point of beginning;
EXCEPT therefrom a right -of -way 60 feet in width for Pacific
Power & Light Company's canal; EXCEPT the right-of-way of
Naches and Cowiche Ditch Company's canal as the said canals
are constructed over and across said premises; AND EXCEPT
that portion of the northwest,quarter of the northwest quarter
of the northwest quarter of said Section 23 lying immediately
north of Lots 1 and 2, Ditter Place, less county road along
the north side thereof; and less right-of-way of Naches and
Cowiche Ditch along the southwesterly side thereof;
PARCEL B;
A portion of said Section 23 described as follows:
Beginning at a point on the west line of said Section 23 a
distance of 305 feet south of the northwest corner thereof;
thence south along the west line of said Section 23 a distance
of 237.2 feet; thence south 89 east a distance of 378.7
feet more or less; thence north 237.2 feet; thence north
89 west 378.7 feet more or less to the point of beginning,
be rezoned from R-1, Single Family Zone, to Planned Development
Zone be, and the same is hereby, approved and said real property
is hereby rezoned to a Planned Development 7one, all in accordance
with, and to conform to, the final development plan and program
therefor approved by the Yakima Planning Commission, a copy of which
is attached hereto and by reference made a part hereof; provided,

the effectiveness of this rezone is subject to the following condi- II,
tions:
1. That the dedication of one-half the radius (the
established radius is 50 feet) for the cul-de-sac
at North 30th Avenue be given, and
2. That the applicants agree to participate in a future
LID for the improvement of 32nd Avenue in the vicinity
of the rezoned property.
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared by
and for the City.
Section 3. The City Clerk is hereby authorized and directed
to file' with the Yakima County Auditor a certified copy of this
ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
