ORDINANCE NO. c2 /0,6 AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning property at 1614 West Prasch from R -2, Two Family Zone, to Planned Development Zone. • WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 12th day of September, 1977, upon the recommendation of the Planning. Commission that real property situated at 1614 West Prasch Avenue in the City of Yakima, Washing- ton, the legal description of which is set out hereinbelow, be rezoned from R -2, Two Family Zone, to Planned Development Zone, and WHEREAS, the City Council finds that such recommendation of the Planning Commission for such rezoning should be approved for the reasons that such rezoning is in accord with good planning and with the General Plan of the City of Yakima; that the majority of property owners in the vicinity do not oppose the change in classifi- • cation; that the needs of the City and community do require such change and that the highest and best use of said property is for Planned Development Zone, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situated at 1614 Prasch Avenue in the City of Yakima, Washington, and more particularly described as follows, to wit: West 68 feet of Lot 3, Block 1, Stone's Addition to North Yakima, Washington, as recorded in Volume "C" of Plats, page 33, records of Yakima County, Washington, be rezoned from R -2, Two Family Zone, to Planned Development Zone be, and the same is hereby, approved and said real property is hereby rezoned to a Planned Development Zone, all in accordance with, and to conform to, the final development plan and program therefor approved by the Yakima Planning Commission, a copy of which is attached hereto and by reference made a part hereof; provided, the grant of this rezone is subject to the condition that a fire hydrant shall be installed by the owner, at the owner's expense, at a loca- tion on the rezoned property as prescribed by the Yakima City Fire Department; with said hydrant to be installed and charged prior to the commencement of construction of improvements on the rezoned property. Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as pro- vided by law and by the City Charter.
