AN ORDINANCE rezoning certain property situated on the southwest
corner of the intersection of 56th Avenue and Summitview
Avenue, within the City of Yakima, from Planned Develop-
ment Zone and R-1, 1-Family Zone, to Planned Development
410) Zone.
WHEREAS, pursuant to the filing with the City of an application
to rezone property described below, and after due notices were given
as required by law, public hearings were held by the Planning Commis-
sion and the City Council of the City of Yakima on the matter of the
rezoning of property described below from Planned Development Zone
and R-1, 1-Family Zone, to Planned Development Zone, and
WHEREAS, as a result of its public hearings and its review of
the record of Planning Commission proceedings, the City Council finds
that the vicinity of the site for which the rezone is sought, and
the westerly area of the City which can reasonably be expected to
be served by the business proposed for the site for which the rezone

is sought, is developed and populated so that a public need exists
for the development of a community shopping center on the site for
which the rezone is sought; and the City Council further finds that
the site for which the rezone is sought is adequately served by
arterial streets in that the site is bounded on the north by Summitview
Avenue and on the east by 56th Avenue, and that the streets in the
vicinity adequately serve the site for which the rezone is sought and
are adequate to accommodate any increase in traffic which may result from
the granting of the rezone application, so that the vehicles and pedestribn
traffic will not be increased or change in pattern in such a manner so as
to create undue traffic congestion or hazards in the vicinity. The City
Council further finds that because of the location and physical charac-
teristics of the property, the highest and best use of the property
for which the rezone ie sought is for Planned Development in accordance
with the plan and program proposed for the rezone of that site; and
that to grant the rezone be in accordance with the General
Plan of the City of Yakima, and
WHEREAS, as a result of its public hearings, and based on
its findings, the City Council concludes that it would be in the
best public interests and in accordance with good planning to
grant the application for the rezone of the property described
below from Planned Development and R-1, 1-Family Zone, to Planned
Development Zone, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The application to rezone the following property
within the City of Yakima, Washington, to wit:
PARCEL A: That portion of the northeast quarter of the northeast quarter of the
southwest quarter of Section 21, Township 13 North, Range 18, E.W.M., in Yakima
County, Washington, described as follows:
Commencing at the northeast corner of said subdivision; thence north 88 51' 0
25" west along the north line thereof 200.00 feet to the northerly extension of the
west line of a parcel leased to Standard Oil Company by instrument recorded under
Auditor's File No. 2101091 and 2137896; thence south along said extension and west
line 38.00 feet to the south margin of Summitview Avenue and the true point of
beginning; thence continuing south along said west line 167.00 feet to the southwest
corner of said leased parcel; thence south 88° 51' 25" east along the south line of
said leased parcel 170.00 feet to the west margin of South 56th Avenue; thence south
along said west margin 323.60 feet to the south line of the north 198 feet of the
south one-half of said northeast quarter of the northeast quarter of the southwest
quarter of Section 21; thence north 88 51' 35" west along said south line 644.03
feet to the west line of said northeast quarter of the northeast quarter of the
southwest quarter of Section 21; thence north 0° 03' 20" east along said-west line
198.00 feet to the south line of the north one-half of said northeast quarter of
the northeast quarter of the southwest quarter of Section 21; thence south 88° 51'
35" east along said south line 150.00 feet to the east line of the west 150 feet of
said subdivision; thence north 0° 03' 20" east along said east line 292.62 feet to
said south margin of Summitview Avenue; thence south 88 51' 25" east along said
south margin 323.56 feet to the true point of beginning.
PARCEL B: That portion of the northeast quarter of the southwest quarter of
Section 21, Township 13 North, Range 18, E.W.M., in Yakima County, Washington,
described as follows:

Commencing at the northeast corner of the northwest quarter of said northeast
quarter of the southwest quarter of Section 21; thence north 88° 51' 25" west along
the north line of said subdivision 100.00 feet to the northerly extension of the
west line of that parcel deeded to Ray K. Embree and Nelda Embree by instrument
recorded under Auditor's File No. 2238998; thence south 0° 03' 20" west along said
extension and line 35.00 feet to the south margin of Summitview Avenue and the true
. poing of beginning; thence continuing south 0 03' 20" west along said west line of
the Embree parcel 275.00 feet to the southwest corner thereof; thence south 89° 56'
40" east along the south line of said parcel 99.98 feet to the west line of the north-
east quarter of said northeast quarter of the southwest quarter of Section 21; thence
south 0° 03' 20" west along said west line 22.52 feet to the south line of the north
one-half of said northeast quarter of the northeast quarter of the southwest quarter
of Section 21; thence south 88° 51' 35" east along said south line 150.00 feet to the
east line of the west 150 feet of said northeast quarter of the northeast quarter of
the southwest quarter of Section 21; thence north 0° 03' 20" east along said east line
292.62 feet to the south margin of said Summitview Avenue; thence north 88° 51' 25"
west along said south margin 150.00 feet to said west line of the northeast quarter of
the northeast quarter of the southwest quarter of Section 21; thence north 0 01' 20"
east along said west line 3.00 feet to said south margin of Summitview Avenue; thence
north 88° 51' 25" west along said south margin 100.00 feet to the true point of
beginning.
411 from Planned Development Zone and R-1, 1-Family 7one, to Planned
Development Zone is hereby granted; and said property is hereby zoned
as Planned Development Zone, all in accordance with, and to conform to,
the final development plan and program therefor, a copy of which is
attached hereto and by reference made a part hereof; provided, that
this rezone is granted with the condition that a further use restric-
tion is hereby imposed on the rezoned property, namely, that no
deliveries of merchandise to the premises shall be made on any day
after eight o'clock p.m. nor before seven o'clock a.m. the following
day.
Section 2. The above change is zoning shall be included and
0 depicted on the next regularly amended Use District Map prepared by
• and for the City.
Section 3. The City Clerk is hereby authorized and directed to
file with the Yakima County Auditor a certified copy of this ordinance.

Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
