HomeMy WebLinkAbout1977-2117 CONSTRUCTING MAINS, FIRE HYDRANTS, VALVES & OTHER APPURTENANCES FOR SUPPLYING WATER FOR DOMESTIC USE & FIRE PR ORDINANCE NO. ca? //7, AN ORDINANCE providing for the improvement of certain property by constructing the necessary mains, fire hydrants, valves and other appurtenances for the purpose of supplying water for domestic use and fire protection; establish - • - ing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. BE. IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The following described property situate in Yakima County, Washington, shall be improved by constructing the necessary mains, fire hydrants, valves and other appurtenances for the purpose of supplying water for domestic use and fire protection: Area I Lots 7 through 13 of the Replat of Lewis - Terry Garden Tracts as recorded in Vol. I of Plats, page 19, records of Yakima County, Washington; TOGETHER with Lots 10 through 16 of Norris Suburban Tracts as recorded in Vol. I of Plats, page 16, records of Yakima County, Washington; EXCEPT that portion of Lot 11 lying east of the west 145.4 feet • thereof; AND EXCEPT that portion of Lot 12 lying east of the west 198.8 feet thereof; AND EXCEPT that portion of Lot 13 lying east of the west 210.9 feet thereof; TOGETHER with Lots 5 through 13 of McGlothern Home Sites No. 3 as recorded in Vol. J of Plats, page 31, records of Yakima County, Washington; TOGETHER with Lots 7 through 12 and Lot 16 of Luke Powell Subdivision as recorded in Vol. I of Plats, page 3, records of Yakima County, Washington; TOGETHER with the east 128.6 feet of Lots 21 and 24 of said �-- Lewis-Terry Garden Tracts; TOGETHER with Lot 31 of said Lewis -Terry Garden Tracts, EXCEPT the south 120 feet of the west 154.60 feet thereof; AND EXCEPT the north 91.3 feet of the west 141.0 feet thereof; TOGETHER with the north 143.8 feet of the west 280.7 feet of Lot 19 of said Lewis -Terry Garden Tracts. Area II Lots 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22 and 23 of the Plat of Epperson Home Sites as recorded in Vol. N of Plats, page 46, records of Yakima County, Washington, and that portion of Section 20, Township 13 North, Range 18 East, W.M. lying • west of a line 98.0 feet east of the east line of 9th Avenue and south of the south line of Washington Avenue and north of the north line of Lot 23 of said Epperson Home Sites. Area III That part of the southwest quarter of the northwest quarter of Section 32, Township 13 North, Range 19 East, W.M. bounded as follows: Commencing at the northwest corner of said subdivision; thence south 0 ° 32' east along the west line of said subdivision 228.63 feet to the point of beginning; thence south 0 ° 32' east 100.0 0 feet; thence north 89 ° 43 ° east 380.00 feet; thence north 0 ° 17' west 100.00 feet to a line bearing north 89 ° 43' east from the point of beginning; thence south 89 ° 43' west 380.44 feet to the point of beginning. Section 2. There is hereby created a Local Improvement District, to be called "Local Improvement District No. 1014," which said district shall include all of the above described property. Section 3. The assessments shall be made according to special benefits derived from the improvements without regard to the zone and termini method. Section 4. All costs and expenses in connection with the construc- tion of said improvement, including the engineering, inspection, adver- tising, publication of notices, and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefor as provided by law and as above described. . Section S. All of the aforesaid construction work shall be in accordance with the plans and specifications, profiles, maps and detailed drawings which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted. Section 6. The work necessary to be done in connection with the making of said improvement shall be done by contract upon competitive bids according to specifications and plans as prepared by the Engineer- ing Division of the Department of Public Works, and the City shall have the power to reject any and all bids. Section 7. There is hereby created a special fund, to be called "Local Improvement Fund, District No. 1014," into which shall be placed • all sums paid on account of the aforesaid special assessments, including all interest and penalties thereon, and in the event of the sale of local improvement bonds by the City, all premium and interest on said bonds issued for said improvement. -2- • • Section 8. Bonds bearing interest at a rate not to exceed 8% per annum, payable on or before 12 years from the date of issuance, shall be issued in payment of the costs and expense of said improve- ", ment, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in ten equal annual installments with interest at a rate not to exceed 81/2% per annum, interest payable annually under the mode of payment "payment by bonds", as defined by the statutes of the State of Washington and the ordinances of the City of Yakima, provided that, this improvement may be financed by the issuance of promissory notes, under the authority of R.C.W. 35.45.150 and Section 8.12.100 of the City of Yakima Municipal Code. Section 9. This ordinance is one relating to local improvements or assessments therefor, and shall become effective immediately upon its passage, approval and publication as provided by law and by the City Charter.
