AN ORDINANCE annexing property to the City of Yakima, and zoning
said property..
WHEREAS, proceedings have been held in accordance with all
applicable laws for the annexation to the City of Yakima of the
property hereinafter described, and
WHEREAS, the Planning Commission of the City of Yakima duly
held a public hearing on the zoning of said property hereinafter
described and annexed and, as a result of said hearing, duly recom-
mended that said property be annexed to the City of Yakima and zoned
as hereinafter specified, and
WHEREAS, more than 60 days have elapsed from the date of the
filing with the Yakima County Boundary Review Board of a notice
of intention regarding such annexation, and the jurisdiction of
that Board was not invoked as provided by R.C.W. 36.93.100, and
such annexation is therefore deemed approved by that Board, and
WHEREAS, pursuant to due and legal notice, the City Council
held a public hearing on said annexation on the 30th day of June,
1975; and, as a result thereof, finds that such property should
be annexed to the City of Yakima and further finds that the property
should be zoned as hereinafter set forth for the reasons that
such zoning and classification is in accord with good planning
and with the General Plan of the City of Yakima, that the majority
of the property owners in the vicinity do not oppose the classi-
fication or the annexation, that the needs of the City and com-
munity do require the hereinafter set forth zoning classification,
and that the highest and best use for said property is as herein-
after determined, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The following described property situated in
Yakima County, Washington, contiguous to the City of Yakima is
hereby annexed to the City of Yakima, Washington:
Beginning at the southwest corner of Lot 4, Huxtable Model
Orchards, recorded in Volume "E" of Plats, page 41, records
of Yakima County, Washington; thence northerly along the
west line and the west line extended of said Lot 4 to the
north line of the south half of the northwest quarter of
Section 21, Township 13 North, Range 18, E.W.M.; thence
easterly along said north line to the west line extended
of Carolyn Addition, recorded in Volume "U" of Plats, page
36, records of Yakima County, Washington; thence southerly
along said west line to the centerline of the Yakima Valley
Canal Company right-of-way; thence southwesterly along
said centerline to the extended line that is the common north-
south line of Lots 5 and 8 of Huxtable Model Orchards; thence
northerly along said line to a point 20 feet southerly of
the northeast corner of Lot 8 of said plat; thence westerly
and parallel with the north line of said Lot 8 to the west
line of Lot 8; thence northerly 20 feet to the northwest
corner of Lot 8; thence easterly along the north line of
Lot 8 to the southwest corner of Lot 4 of said plat, the
point of beginning.
Section 2. The owners of the hereinbefore described real
property annexed to the City of Yakima shall be required to assume
existing indebtednesses of the City of Yakima.
Section 3. The hereinbefore described real property annexed
to the City of Yakima is hereby zoned as follows:
(a) The following described property is hereby zoned as R-1,
Single-Family Zone:
That portion of Lots 4 and 5 and the West 43.7 feet of Lot
6, Huxtable Model Orchards, according to the official plat
thereof recorded in Volume "E" of Plats, page 41, records
of Yakima County, Washington, described as follows:
Beginning at a point South 89 East 215.4 feet from the
northwest corner of said Lot 4; thence South 1 East 212.2
feet; thence North 8748' East 120 feet; thence North 1
West 206.5 feet; thence North 89 West 120 feet to the
point of beginning; and
Beginning at the northwest corner of said Lot 5; thence South
89 East 215 feet to the true point of beginning; thence
South 89 East 134.7 feet; thence South 01 East 130
feet; thence North 89 West 134.7 feet; thence North 01
West 130 feet to the true point of beginning; and
Beginning at the Northwest corner of said Lot 5; thence South
89 East 215 feet to the true point of beginning; thence
South 1 East 130 feet; thence North 89 West 125 feet;
thence North 1 West 130 feet; thence South 89 East
125 feet to the true point of beginning.

(b) All of the property hereby annexed to the City of Yakima
as'. described in Section 1 hereof is hereby zoned as Planned Develop-
ment Zone, except for that portion thereof zoned R-1, Single Family
Zone, as described and provided in Section 3 (a) hereof, all in
accordance with, and to conform to, the final development plan
and program therefor approved by the Yakima Planning Commission
a copy of which is attached hereto and by reference made a part
hereof.
Section.4. The next regularly amended Use District Map pre-
pared by and for the City of Yakima shall show said property as
hereinbefore zoned and classified.
Section 5. The City Clerk is hereby authorized and directed
to file a certified copy of this ordinance with the County Auditor
of Yakima County and with the Board of County Commissioners of
Yakima County, Washington.
Section 6. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
