ORDINANCE NO. _AP.50 AN ORDINANCE relating to funds and accounts; creating a Bicenten- nial Pavilion Parking Fund as a special fund; speci- fying sources of funds and purposes for expenditures from the. Bicentennial Pavilion Parking Fund; enacting Section 3.93.050 as a new section of the City of Yakima Municipal Code; and declaring an emergency. 411 BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 3.93.050 is hereby enacted as a new sec- tion of the City of Yakima Municipal Code to read as follows: "3.93.050 Bicentennial Pavilion Parking Fund. A. Fund created. There is hereby created a special fund to be known as the Bicentennial Pavilion Parking Fund. B. Source of funds. All revenue paid to the City by the County of Yakima as proceeds from the special excise tax imposed by the County of Yakima pursuant to R.C.W. 67.28.180 shall be deposited in the Bicentennial Pavilion Parking Fund, together with funds from other sources as may be determined from time to time by the Yakima City Council. C. Purpose--Expenditures. Expenditures from • the Bicentennial Pavilion Parking Fund shall be made only for the purpose of acquiring and constructing parking lots and related facilities to serve the con- vention center facilities to be paid from the Bicen tennial Pavilion Construction Fund created by Section 3.93.040 of this chapter. No expenditure shall be made from such fund unless the City Council shall approve such expenditure by passing an ordinance appropriating money within the fund for the purpose for which the expenditure is to be made or by includ- ing an appropriation for such purpose in the budget." Section 2. This ordinance is one to provide for the immediate preservation of the public peace, property, health, safety and welfare of the people of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
