AN ORDINANCE relating to licenses and business regulations; requir-
ing licenses and permits and prescribing license and
permit fees for various persons, business and activi-
ties; amending Sections and Subsections 5.02.020,
5.02.090, 5.08.010, 5.09.020 (b) •and (c), 5.09.070
(b), 5.09A.020 B, 5.10.010, 5.12.020 (a), 5.14.160,
5.18.020, 5.26.120, 5.28.060, 5.28.070, 5.28.100 B,
5.40.030, 5.42.020, 5.46.030, 5.54.020, 5.62.030,
5.64.030, 5.78.060, 5.78.120, 5.78.170 (b), 6.20.110,
6.22.050, 11.08.040, 11.08.110 and 11.32.130, all of
the City of Yakima Municipal Code; and declaring an
emergency.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 5.02.020 of the City of Yakima Municipal Code
is hereby amended to read as follows:
"5.02.020 Circuses. Every circus and menagerie com-
bined parading or exhibiting within the city charging an
admission fee of fifty cents, shall pay a license fee of
five dollars per car for each car, except sleeping cars,
in the train used to move the circus for each day's exhibi-
tion, and every circus and menagerie combined, charging
an admission fee of less than fifty cents shall pay a license
fee of three dollars and fifty cents per car for each car,
except sleeping cars, in the train used to move said circus,
for each day's exhibition; provided, that said fee shall
not exceed the sum of two hundred dollars. Every street
fair, carnival or dog and pony show, so-called, held in any
building, enclosure or tent within the city of Yakima to
which an entrance fee is charged, shall pay a license fee
of fifty-five dollars per day; and every kind of athletic
exhibition, contest or game given or held in any building
or tent to which an entrance fee is charged or for which
a collection is taken from the patrons therefrom within
the city of Yakima, excepting wrestling contests and boxing
contests when conducted by any athletic association or
club whose members only are admitted, shall pay a fee to the
city of Yakima of fifty-five dollars for a permit to hold
such exhibition; provided, that the city manager may, in
his discretion, or for any cause deemed sufficient, refuse
to grant any license or permit whatever for any street
fair, carnival, dog and pony show, wrestling match or other
athletic exhibition, so-called. All licenses when granted
for any circus, street fair, carnival or dog and pony show,
shall include the side show exhibitions and also the right
to sell toy balloons and other novelties on the streets
of Yakima, and to sell lemonade, peanuts, candy, fruits,
popcorn and other refreshments on the grounds occupied by
said circus, street fair, carnival or dog and pony show,
subject, however, to all ordinances, rules and regulations
of the health department of the city of Yakima relative to
sanitation. Any other person desiring to sell refreshments
on the grounds and outside the tents belonging to said
circus, street fair, carnival or dog and pony show, shall
pay a license fee of three dollars per day, and in all
respects comply with the ordinances and requirements of the
health department relating to sanitation. Every circus,
street fair, carnival or dog and pony show, so- called, shall
deposit or cause to be deposited, with the city treasurer
of Yakima fifty dollars as a guarantee that the grounds
so occupied will be thoroughly cleaned and all garbage and
refuse disposed of to the entire satisfaction of the health
department of said city, and also to pay the city for any
damages to sidewalks, trees or other public property, and
no license shall be issued until such deposit is made."
Section 2. Section 5.02.090 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"5.02.090 Transient Merchants. Every person, firm or
corporation, who, either in person or by agent, sells or
offers to sell any goods, wares or merchandise within the
City of Yakima, without any manifest intention of permanently
settling, locating or residing in the City of Yakima, and
who is not permanently located or residing in the City of
Yakima, for the purposes of carrying on a temporary or
transient business in the City of Yakima, shall hire, or
lease or occupy any building, tent or other structure for
the exhibition and sale of any such goods, wares and merchan-
dise, shall be deemed to be an itinerant or transient mer-
chant. Such merchant selling or in any manner offering for
sale any goods, wares or merchandise within the City of Yakima
shall pay as a license fee therefor, for any period less •
than one month, at the rate of fifty -five dollars per day.
Where such license shall be taken out for the period of one
month, the fee therefor shall be the sum of three hundred
thirty dollars and for each succeeding month thereafter
the fee shall be the sum of two hundred twenty dollars per
month."
Section 3. Section 5.08.010 of the City of Yakima Municipal Code
is hereby amended to read as follows:
"5.08.010 License required - -Fee. It shall be unlawful
for any oil company, association, corporation, firm, person
or concern to make delivery of gasoline or oil, other petroleum
products or aviation fuel to the Yakima Air Terminal without
first securing a license so to do hereby designated as
'airport petroleum license'. Such license shall be obtained
from the city clerk and shall expire on the first day of
July of each year. The annual fee for such license is
hereby fixed in the sum of twenty -seven dollars and fifty
cents."
Section 4. Subsections 5.09.020 (b) and (c) of the City of Yaki•'.
Municipal Code are hereby amended to read as follows:
"5.09.020 Application for license - -Fee.
(b) An application hereunder shall be accompanied by
a fee of fifty -five dollars for each ambulance regardless
of whether the license applied for is issued. Such license

shall be valid for a period of one year from its date of issue
unless revoked as provided in this. chapter. Any applica-
tion for renewal or re-issuance of an ambulance business
license shall be accompanied by a fee of fifty-five dollars for
each ambulance listed on the application form for renewal
or re-issuance of the license.
(c) In the event a licensee intends to use an
ambulance in connection with his business during the
license year which ambulance is not listed on the applica-
tion form for the license he then holds, licensee shall
notify the city clerk in writing of that fact, which notice
shall be given prior to the time such ambulance is actually
so used, and which notice shall designate the make and model
of any such ambulance, which notice shall be accompanied
by a fee of fifty-five dollars for each such ambulance."
Section 5. Subsection 5.09.070 (b) of the City of Yakima Muni-
cipal Code is hereby amended to read as follows:
"5.09.070 A,,lication for Dermit--Fee.
(b) An application hereunder shall be accompanied by
an application fee of eleven dollars which fee shall be
retained by the City regardless of whether the permit applied
for is issued. Such a permit shall be valid for a period
of one year from its date of issue unless revoked as provided
111 in this chapter, and may be renewed from year to year there-
after by an application to the city clerk accompanied by a
renewal fee of eleven dollars for each annual renewal."
Section 6. Subsection 5.09A.020 B of the City of Yakima Muni-
cipal Code is hereby amended to read as follows:
"5.09A.020 Application for license--Fee.
B. An application for a mobile intensive care busi-
ness license shall be accompanied by a fee of fifty-five
dollars which shall not be reimbursed regardless of whether
the license is issued. Such license shall be valid for a
period of one year from its date of issue unless revoked
as provided by this chapter."
Section 7. Section 5.10.010 of the City of Yakima Municipal Code
is hereby amended to read as follows:
5.10.010 License required--Fee. No person, firm or cor-
• poration shall own, operate or conduct, within the corporate
limits of the city of Yakima, any arcade, penny arcade,
fun house, or similar place of amusement without first
securing from the city of Yakima a license so to do; the
license fee therefor is hereby fixed at the sum of one
hundred ten dollars, and all licenses issued hereunder
shall expire one year from the date of issuance."

Section 8. Subsection 5.12.020 (a) of the City of Yakima Muni-
cipal Code is hereby amended to read as follows:
"5.12.020 Licenses reduired for certain amusement
devices--Fees.

(a) It shall be unlawful for any person, film, cor-
poration or association to install, maintain or operate,
in any business establishment or for the purpose of profit,
any of the following amusement devices without first
obtaining from the city clerk a license so to do and
without first paying to the city the applicable license
fee in the following respective amounts:
(1) Shuffleboards; fifty-five dollars each.
(2) Miniature bowling machines or bowling board,
ray guns, dart throwing devices and similar amusement
devices; twenty-seven dollars and fifty cents each.
The fees specified are annual fees, and shall be paid
in full in advance of January 1 of each year, to be effective
for the following year."
Section 9. Section 5.14.160 of the City of Yakima Municipal Code
is hereby amended to read as follows:'

"5.14.160 License Fees. Before any license shall be
issued, the following license fees shall be paid to the city
treasurer:
Auctioneers shall pay a license fee of two hundred twenty
dollars per annum; but, for a shorter period than one year,
the rates shall.be as follows:
For any period of one month or less, at the rate of
' eleven dollars per day;
For any period of more than one month and not to exceed
three months, at the rate of six dollars and fifty cents per
day;
For a period exceeding three months and not to exceed
six months, at the rate of four dollars and fifty cents
per day;
Auction merchants shall pay a license fee of five hun-
dred fifty dollars per annum; and, fir a shorter period than
one year, at the following rates:
For a period of less than one year, three hundred eighty-
five dollars, but no license shall be issued for a shorter
period than six months.
For temporary auctions and closing out auctions, there
shall be paid a license fee of three hundred eighty-five
dollars per month and, for every day less than one month,
the sum of fifty-five dollars per day."

Section 10. Section 5.18.020 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"5.18.020 Fees. The license fee for each billiard
table or pool table shall be the amount of thirty-eight
dollars and fifty cents per annum, payable annually in
advance to the city clerk at the time application is made
for such license."
Section 110 Section 5.26.120 of the City of Yakima Municipal
Code is hereby amended to read as follows: -
"5.26.120 License fee. The license fee for each 'sale
of distress merchandise under this chapter shall be and
is hereby fixed in the sum of fifty -five dollars, plus five
dollars for each one thousand dollars or fraction thereof
of the value of inventory submitted with the application
for license."
Section 12. Section 5.28.060 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"5.28.060 License fee. The license fee for each dance
hall or each cabaret shall be fifty -five dollars per year."
• Section 13. Section 5.28.070 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"5.28.070 Permit fee for public dance. The permit
fee for public dances shall be as follows: two hundred
seventy -five dollars for one year; eighty -two dollars and
fifty cents for three months and sixteen dollars and fifty
cents for one night."
Section 14. Subsection 5.28.100 B of the City of Yakima Municipal
Code is hereby amended to read as follows:
"5.28.100lication for permit.
B. The application fee for each permit issued under
this chapter shall be sixteen dollars and fifty cents, which
amount shall be credited to payment of the permit fee.
Application fees shall not be refundable."
Section 15. Section 5.40.030 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"5.40.030 Fee. The annual license fee for a juke box
license shall be twenty -seven dollars and fifty cents per
year, payable on or before the 1st day of July of each
year. In the event that such license shall be surrendered
or revoked for cause, no part of the license fee shall
be refunded. The license herein provided for shall not
be transferable from one person to another, or from one
location to another, or from one juke box to another."

Section 16. Section 5.42.020 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"5.42.020 Licenses required - -Fees. It is unlawful
for any person, firm or corporation to engage in the busi-
ness of buying, selling or collecting junk in the city
of Yakima without first obtaining from the city a license Al,
so to do, which shall be known as a junk dealer's license.
The fee for issuing such license shall be one hundred ten
dollars per annum, and no license shall be issued for a
period of more or less than one year."
Section 17. Section 5.46.030 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"5.46.030 Fee—Designation of floor space - -Term.
• (a) The fee for such license shall be the sum of two hundred
twenty dollars per year or fraction thereof, except as pro -
vided by subsection (b) hereof; Provided that if such es-
, tablishment has dance space in excess of five hundred square
feet and not exceeding seven hundred fifty square feet,
such fee shall be three hundred thirty dollars; if such
dance space exceeds seven hundred fifty square feet and
not exceeding one thousand square feet, such fee shall be
four hundred forty dollars; and if such dancing floor space
{ , exceeds one thousand square feet, such fee shall be five
hundred fifty dollars. The floor space to be used for dancing
shall be designated by enclosing the same on four sides •
with a black line four inches wide painted on the floor
and dancing shall be confined to such designated floor
space. Such license shall be effective for the period
beginning January .1st and ending December 31st of the same
year or for any portion thereof, except as provided in
subsection (b) hereof.
(b) In the event the activity to be licensed by this
chapter is to be conducted for five days or less, a temporary
license fee of sixteen dollars and fifty cents shall be
paid by the licensee for each day the licensed activity is
to be conducted, which temporary license fee shall be col-
lected by the city in lieu of the annual license fee called
for by subsection (a) hereof.
(c) The application fee for each permit issued under
this chapter shall be sixteen dollars and fifty cents which
amount shall be credited to payment of the permit fee.
Application fees shall not be refundable."
Section 18. Section 5.54.020 of the City of Yakima Municipal
Code is hereby amended to read as follows: •
"5.54.020 License reuuired--A..lication-- Bond- -Fee --
Transfer. No person shall engage in the business of a pawn -
broker in the city of Yakima without first procuring a license
therefor, and in order to procure a license he shall present
to the city clerk an application which shall contain the
name of the, applicant, the place where he proposes to con-
duct his business, the name under which the same shall be
conducted, the names of persons interested in the business,
if a co- partnership or corporation, and in addition thereto
shall supply the city clerk with such other and further
info/mation as may be required to administer the provisions

of this chapter. If such application is approved the city
clerk shall issue a license to the applicant upon his execut-
ing and delivering to the city of Yakima a bond to be approved
by the city attorney in the sum of one thousand dollars
conditioned that he will conduct such business in compliance
with all of the ordinances of the city of Yakima and the
laws of the state of Washington. The license fee shall
be the sum of eighty-two dollars and fifty cents per annum.
Said license shall not be assignable or transferable."
Section 19. Section 5.62.030 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"5.62.030 Fee--Term--Transfer. The fee for a private
detective agency license shall be fifty-five dollars per
annum. The fee for a private detective license shall be
twenty-seven dollars and fifty cents per annum. All
licenses shall expire on the 31st day of December of
the year of issue. No license shall be transferable."
Section 20. Section 5.64.030 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"5.64.030 License re.uired--A..lication. No person
shall engage in the business of a secondhand dealer in
the city of Yakima without first procuring a license there-
., for, and in order to procure a license he shall present
to the city clerk an application which shall contain the
name of the applicant, the place where he proposes to
conduct his business, the name under which the same shall
be conducted; if a co-partnership, the names of the mem-
bers of the firm; if a corporation, the names of its offi-
cers; and in addition thereto shall supply the city clerk
with such other and further information as may be required
to administer the provisions of this chapter. If such
application is approved the city clerk shall issue a license
• to the applicant upon his paying a license fee of twenty-
seven dollars and fifty cents. Said license shall not be
assignable or transferable."
Section 21. Section 5.78.060 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"5.78.060 Fees. The license fee for the respective
types of for-hire vehicles shall be as follows:
(a) Taxicab--Fifty-five dollars per year, or for
41, any portion of a year;
(b) Sight-seeing car--One hundred ten dollars per
vehicle per year, or for any portion of a year."
Section 22. Section 5.78.120 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"5.78,120 Taxicab stands. The traffic engineer of
the city of Yakima may designate and set aside spaces •on

the public streets where for-hire vehirles may stand while
awaiting employment. The city clerk, nay, upon application
therefor, issue a permit to the owner of a for-hire vehicle
granting him the exclusive use of any .3uch space not pre-
viously designated for such use by another person. No per-
mit shall be issued unless the applicant shall furnish proof
of compliance with all laws of the state of Washington and AM&

ordinances of the city of Yakima relating to and governing
the operation of for-hire vehicles and has attached to his
application the written consent of the owner or lessee of
the property abutting such space to the use of such space
for a taxicab stand. It is unlawful for any person to
solicit, offer, give or receive, either directly or indirectly,
anything of value as consideration for such written consent.
The applicant for a permit contemnlated by this section shall
pay to the city the amount of eighty-two dollars and fifty
cents each year for each space assigned to his exclusive
use. The holder of a permit for exclusive use of any such
space may obtain a transfer of his permit to another space,
' approved by the traffic engineer, on complying with the pro-
visions of this section and by the payment of a transfer
fee in the amount of forty-four dollars to the city clerk."
Section 23. Subsection 5.78.170 (b) of the City of Yakima Muni-
cipal Code is hereby amended to read as follows:
"5.78.170 City driver's license--Application and
renewal fee.

(b) The fee for a city driver's license is hereby
fixed at eleven dollars each year."
Section 24. Section 6.20.110 of the City of Yakima Municipal
Code is hereby amended tb read as follows:
"6.20.110 Redemption of dogs. The owner of any dog
impounded for running at large or for being unlicensed
may redeem the same within forty-eight hours after receiving
notice of the impounding or the posting of the notice as
hereinabove provided upon the payment to the impounding
authority of an impounding fee of ten dollars, together
with any unpaid license fee for a dog. If such dog is not
redeemed by the owner within such period of forty-eight
Eours, then any person may redeem the same by complying with the
above provisions, or, within the discretion of the impound-
ing authority, such dog may be humanely destroyed or other-
wise disposed of. An additional charge of not to exceed
one dollar and ten cents per day may be imposed for the time
that such dog is kept at the pound after impounding."
Section 25, Section 6.22.050 of the City of Yakima Municipal Code
is hereby amended to read as follows:
"6.22.050 License fees. For the year from February 1,
1976, through January 31, 1977, and for each year thereafter,
the annual license fees for owning, keeping or having control

of dogs, and dog and cat kennels, in the city of Yakima
shall be as follows:
Each dog, male or female . . ... . 6.00
Dog kennel ...... . ..... . 27.50
Cat kennel--six or more cats . . . . 11.00

Provided, that in the case of dogs or kennels previously
licensed, there shall be an additional fee of four dollars
for each dog or kennel license which is purchased more
than sixty days after the first day of February of any
year."
Section 26. Section 11.08.040 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"11.08.040 Amendment to Section S-304. Section S-304
of the uniform sign code, adopted by this chapter, is hereby
amended to read as follows:
'S-304 Fees. A sign permit and plan check fee
fee shall be paid in accordance with the following
schedule:
PERMIT FEE SCHEDULE
111 Type Size Fee
Ground Signs under 100 sq. feet $5.50 minimum
100 to 250 sq. feet 11.00
250 sq.ft. or larger 11.50
Marquee Signs, under 100 sq. ft, 5.00 minimum

Projecting, 'Pole under 50 sq. ft. 5.00 minimum
and Roof—SIgns over 50 sq. ft. .10 sq. ft.

Fee
For the purpose of computing the maximum permitted size
and permit fee, free standing letters or characters,
where no background is specially provided, the area shall
be considered as that encompassed by drawing straight
lines at the extremities of the shapes to be used.'"
Section 27, Section 11.08.110 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"11.08.110 License fee. The annual license fee for
all licenses provided for by this chapter shall be eighty-
two dollars and fifty cents, payable in advance on or before

January 1 of each year, provided, a license may be issued
for any application filed after August 31 of any year on
payment of one-half the annual license fee, which license
shall expire and be subject to renewal on or before Decem-
ber 31 of that year."
Section 28. Section 11.32.130 of the City of Yakima Municipal 4 0

Code is hereby amended to read as follows:
"11.32.130 Journe an's license or amprentice 'emit--
Fee. The fee for such journeyman's license shall be eleven
dollars and eleven dollars for renewal, per year for each
person, payable to the city clerk. The fee for such appren-
tice permit shall be five dollars and fifty cents per year for
each person payable to the city clerk. Each separate examina-
tion will require payment of a fee of five dollars and fifty
cents, payable to the inspection department of the city."
Section 29. This ordinance is one to provide for the immediate
preservation of the public peace, property, health, safety and wel-
fare of the people of the City of Yakima and an emergency is hereby
declared to exist and this ordinance shall be in full force and effect
immediately upon its passage, approval and publication as provided by
law and by the City Charter.
