For Meeting of: April 2, 2019 Resolution authorizing an agreement with Yakima County for Certified Acceptance Services Scott Schafer - Public Works Director Robert Desgrosellier - Acting Chief Engineer, 575-6228 SUMMARY EXPLANATION: The City of Yakima (City) has been awarded federal Surface Transportation Program (STP) funds for Phase 1 of the North 1st St. Revitalization Project. The expenditure of federal funds requires that the project be designed and administered in accordance with the Washington State Department of Transportation Local Guidelines, including certification by a certified acceptance agency (CA agency). Currently, the City does not have a City Engineer certified to provide the required Certified Acceptance Services. The Local Agency Guidelines does provide that a local agency may enter into an ILA with a CA agency to have the CA agency perform project development and/or contract administration. Yakima County is presently certified as a CA agency and is willing to enter into an ILA to provide the City with Certified Acceptance Services. The ILA is attached for City Council review. The City shall reimburse Yakima County for costs associated with services provided on a time and materials basis. The costs will be incorporated and funded as part of the Phase 1 N. 1st St. Revitalization Project. R -2019- A RESOLUTION authorizing an Interlocal Agreement with Yakima County for Yakima County to perform Certified Acceptance Services. WHEREAS, the City of Yakima (City) has been awarded federal Surface Transportation Program (STP) funds for Phase 1 of the North 1st St. Revitalization Project; and, WHEREAS, the City desires to utilize these federal funds to undertake Phase 1 of the North 1st St. Revitalization Project; and, WHEREAS, the expenditure of federal funds requires that the project be designed and administered in accordance with the Washington State Department of Transportation Local Guidelines, including certification by a certified acceptance agency (CA agency); and, WHEREAS, the City currently does not have a City Engineer certified to provide the required Certified Acceptance Services; and, WHEREAS, the Local Agency Guidelines provides that a local agency may enter into a ILA with a CA agency to have the CA agency perform project development and/or contract administration; and, WHEREAS, Yakima County is presently a CA agency willing to enter into a ILA to provide the City with Certified Acceptance Services; and, WHEREAS, the City Council deems it to be in the best interests of the City to enter into an ILA with Yakima County, which allows Yakima County to perform Certified Acceptance Services for the City, now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized to execute an ILA with Yakima County, which allows Yakima County to perform Certified Acceptance Services for the City. ATTEST: Kathy Coffey, Mayor Sonya Clear Tee, City Clerk 4 AGREEMENT FOR CERTIFIED ACCEPTANCE SERVICES THIS AGREEMENT is entered into between Yakima County, Washington (hereinafter referred the "County") through its Public Services Department, whose address is 128 North 2nd Street, Yakima, Washington 98901, and the City of Yakima (hereinafter the "City"), whose address is 129 North 2nd Street, Yakima, Washington 98901. WHEREAS, the CITY has been awarded federal STP funds for the North First St. Revitalization, Phase 1;(hereinafter the "Project"); and, WHEREAS, the City desires to utilize these federal funds to undertake the Project; and, WHEREAS, the expenditure of federal funds requires that the project be designed and administered in accordance with the Washington State Department of Transportation Local Agency Guidelines, including certification by a certified acceptance agency (CA agency); and, WHEREAS, the County is presently certified to administer federal aid projects; and, WHEREAS, the Local Agency Guidelines provides that a local agency may enter into agreement with a CA agency to have the CA agency perform project development and/or contract administration; and, system; WHEREAS, the accomplishment of the project is a benefit to the regional transportation NOW, THEREFORE IT IS HEREBY AGREED as follows: 1. The County will administer and certify the project for the City in accordance with the Washington State Department of Transportation Local Agency Guidelines. 2. The City will: 2.1. Provide construction inspection services through the City's consultant in accordance with the Local Agency Guidelines; and; 2.2. Reimburse the County for Services provided by the County on a time and materials basis when billed by the County. 3. This Interlocal Agreement shall be in full force and effect when executed by the City and County.
