AN ORDINANCE providing for the improvement of certain property
by constructing a pipe sewer with the necessary wye
branches and manholes; establishing a Local Improvement
District, providing for the method of payment thereof,
and creating a special fund.

.BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The following described property situate in Yakima
County, Washington, shall be improved by constructing a pipe sewer
with the necessary wye branches and manholes:
Lots 1 through 33 and 47 through 52, Varker Addition;
Lots 1 through 12, Varker Replat;
Lots 52 through 77, Westwood West Addition;
North 170 feet of the east 95 feet of the north 360 feet of
the west 363 feet of the northeast quarter of the northwest
quarter of Section 28, Township 13 North, Range 18, E.W.M ,
except the west 6 feet of the north 155 feet;
East 81 feet of the west 274 feet of the north 155 feet of the
northeast quarter of :the northwest quarter of Section 28, Town-
e ship 13 North, Range 18, E.W.M ;
Lots 1 through 7, Newman Addition;
Lots 1 through 40, Wesland Acres;
East half of the west half of the southeast quarter of the
southeast quarter of the southwest quarter of Section 21,
Township 13 North, Range 18, E.W.M ;
The south 374.6 feet of the east half of the southeast quarter
of the southeast quarter of the southwest quarter of Section 21,
Township 13 North, Range 18, E W.M.;
North half of the northeast quarter of the southwest quarter
of Section 21, Township 13 North, Range 18, E.W.M., except the
east 286 feet;
West half of the north .132 feet of the south half of the north-
east quarter of the northeast quarter of the southwest quarter
of Section 21, Township 13 North, Range 18, E.W.M.;
The north 310 feet of the northwest quarter of the northeast
410 quarter of the southwest quarter of Section 21, Township 13
North, Range 18, E W.M.;
Lots 8 through 28, Westgate Addition;
The northerly 245 feet of the following:
Beginning 35 feet south of the northeast corner of the north-
west quarter of the southwest quarter of Section 21, Township
13 North, Range 18, E.W M ; thence south 1101.1 feet; thence
61 west 436.94 feet to right-of-way of Congdon Ditch; thence
northerly along said right-of-way to a point lying west of the
point of beginning; thence east to point of beginning;
Lots 1 through 20, Sunset Crest Homesites;
Lots 1 through 27, Witherell Subdivision;
Lots 1 through 28, Kuntz Subdivision;
Lots 1 through 35, Kuntz Subdivision No. 2;
Lots 1 through 25, Westhaven Addition;
The southwest quarter of the southwest quarter of the southwest
quarter of Section 21, Township 13 North, Range 18, E.W.M.;
Lots 26 through 32, Hiland Manor Addition;
Lots 29 through 35, Parson's Plat;
The west 500.13 feet of that part of the northwest quarter of
the southwest quarter of Section 21, Township 13 North, Range
18, E.W.M , lying north of the Yakima Valley Canal;
That part of the west 450.87 feet of the northwest quarter of
the southwest quarter of Section 21, Township 13 North, Range
18, E.W.M., lying southerly of the Yakima Valley Canal;
• That part of the northeast quarter of the southeast quarter of
Section 20, Township 13 North, Range 18, E.W.M., lying easterly
of 65th Avenue.
Section 2. There is hereby created a Local Improvement District,
to be called "Local Improvement District No. 1007," which said dis-
trict shall include all of the above described property.
Section 3. The assessments shall be made according to special
benefits derived from the improvements without regard to the zone and
termini method.
Section 4. All costs and expenses in connection with the con-
struction of said improvement, including the engineering, inspection,
advertising, publication of notices, and all other expenses incident
• thereto, shall be levied and assessed against all of the property
legally and properly assessable therefor as provided by law and as
above described.
Section 5. All of the aforesaid construction work shall be in
accordance with the plans and specifications, profiles, maps and
detailed drawings which have been prepared by the City Engineer, filed
with the City Clerk, and which are hereby approved and adopted.

Section 6. The work necessary to be done in connection with
the making of said improvement shall be done by contract upon com-
petitive bids according to specifications and plans as prepared by
41/ the Engineering Division of the Department of Public Works, and
the City shall have the power to reject any and all bids.
Section 7. There is hereby created a special fund to be called
"Local Improvement Fund, District No. 1007," into which shall be
placed all sums paid on account of the aforesaid special assessments,
including all interest and penalties thereon, and in the event of
the sale of local improvement bonds by the City, all premium and
interest on said bonds issued for said improvement.
Section 8. Bonds bearing interest at a rate not to exceed 8%
per annum, payable on or before 12 years from the date of issuance,
shall be issued in payment of the costs and expense of said improve-
* ment, which bonds shall be redeemed by the collection of special
assessments to be levied and assessed upon the property within said
district, payable in ten equal annual installments with interest
at a rate not to exceed 81/2% per annum, interest payable annually
under the mode of payment "payment by bonds", as defined by the
statutes of the State of Washington and the ordinances of the City
of Yakima, provided that, this improvement may be financed by the
issuance of promissory notes, under the authority of R.C.W. 35.45.150
and Section 8.12.100 of the City of Yakima Municipal Code.
Section 9. This ordinance is one relating to local improvements
or assessments therefor, and shall become effective immediately
410 upon its passage, approval and publication as provided by law and
by the City Charter.
