AN ORDINANCE accepting the recommendation of the Planning Commis-
sion and rezoning property situated in the recently
annexed Summitview-Cascade Vista Areas.
• WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held hearings on the 3rd day of November,
1975, and the 5th day of January, 1976, upon the recommendation of
the Planning Commission that real property in the recently annexed
Summitview-Cascade Vista areas in the City of Yakima, Washington,
the legal description of which is set out hereinbelow, be rezoned,
and
WHEREAS, the City Council finds that such recommendation of
the Planning Commission for such rezoning should be approved for
the reasons that such rezoning is in accord with good planning and
with the General Plan of the City of Yakima; that the majority of
the property owners in the vicinity do not oppose the change in
111 classification; that the needs of the City and community do require
such change and that the highest and best use of said property is
for the uses as outlined below, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of
the City of Yakima that the following described property
situated in the recently annexed Summitview-Cascade Vista areas
in the City of Yakima, Washington, and more particularly described
as follows, to wit:
North 310 feet of the northwest quarter of the northeast
quarter of the southwest quarter of Section 21, Township 13
North, Range 18, E W.M., EXCEPT road right-of-way on the north
side,

be rezoned from R-1, Single-Family Zone, to B-3, General Business Zone,
Lots 6 and 7 of Roy's Addition, recorded in Volume "V" of
Plats, page 49, records of Yakima County, Washington,
Lots 1, 2, 7 and 8 in the plat of Westhaven recorded in
Volume "V" of Plats, page 14, records of Yakima County,
Washington, and
Lot 1 of the plat of Wesland Acres recorded in Volume "Q"
of Plats, page 2, records of Yakima County, Washington,
be rezoned from R-1, Single-Family Zone, to B-2, Local Business Zone,
The East 11.35 acres of that part of the southwest quarter
of the northeast quarter of Section 21, Township 13 North,
Range 18, E.W.M.., lying below the Yakima Valley Canal,
IS The east half of the northeast quarter of the southeast
quarter of Section 21, Township 13 North, Range 18, E.W.M.,
EXCEPT the east 330 feet of the south 660 feet of said
northeast quarter of the southeast quarter, and EXCEPT
the north 155 feet of the east 145 feet of the northeast
quarter of the southeast quarter of Section 21, Township
13 North, Range 18, E.W.M.,
EXCEPT the north 30 feet and the east 20 feet for roads and
EXCEPT that portion platted as Roy's Addition as recorded
in Volume "V" of Plats, page 49, records of Yakima County,
Washington, and
The west half of the northeast quarter of the southeast
quarter of Section 21, Township 13 North, Range 18, E.W.M.,
be rezoned from •R-1, Single-Family Zone, to R-4, Suburban Residence
Zone,
Lotsl, 2, 3, 4 and 5 of Roy's Addition recorded in Volume
"V" of Plat4,page 49, records of Yakima County, Washington,

Beginning at the Southeast corner of Lot 37 of McCargars
Westside Tract, as recorded in Volume "V" of Plats, page
32, records of Yakima County, Washington, thence westerly
along the south line and south line extended of said Lot
37 to a point 8 feet east of the southwest corner of Lot
36 of said plat, thence northerly parallel with the west
line of said Lot 36 to the north line thereof, thence
easterly along the north line of Lots 36 and 37 to the
northeast corner of Lot 37, thence southerly to point of
beginning,
be rezoned from R-1, Single-Family Zone, to R-2, Two-Family Zone,
Beginning 889.60 feet west of the southeast corner of the
southeast quarter of the southeast quarter of the northeast
quarter of Section 21, Township 13 North, Range 18, E.W.M.,
thence north 205 feet, thence west 130.56 feet to a point
331.32 feet east of the west line of said subdivision,
thence south 1 east 205.05 feet to the south line,
thence east 125.83 feet to point of beginning,
EXCEPT the south 38 feet for road right-of-way,
be rezoned from R-1, Single-Family Zone, to B-1, Modified Business
Zone,

All of the lots in the plat of Westhaven, recorded in
Volume "V" of Plats, page 14, records of Yakima County, Washing-
ton, except Lots 1, 2, 7 and 8,
be rezoned from R-1, Single-Family Zone, to R-3, Multiple Family
400 Zone, and
South 180 feet of the East 320 feet of the northwest
quarter of the southeast quarter and the north 636.125 feet
of the east 320 feet of the southwest quarter of the
southeast quarter and the east 28 feet of the north 653.875
feet of the south 683.875 feet of the southwest quarter
of the southeast quarter, except roads,
be rezoned from R-1, Single-Family Zone, to M-1, Light Industrial
Zone, be, and the same is hereby, approved and said real property
is hereby •rezoned.
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared
by and for the City.
Section 3. The City Clerk is hereby authorized and directed to
file with the Yakima County Auditor a certified copy of this ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
