AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning property at 55 West Washington Avenue in
the City of Yakima, Washington, from R-2, Two-Family
Zone, to Planned Development Zone.
01/ _ • WHEREAS, pursuant to due and legal notice, the City Council of
the City of Yakima held a hearing on the 5th day of January, 1976,
upon the recommendation of the Planning Commission that real property
situated at 55 West Washington Avenue in the City of Yakima, Washing-
ton, the legal description of which is set out hereinbelow, be rezoned
from R-2, Two-Family Zone, to Planned Development Zone, and
WHEREAS, the City Council finds that such recommendation of the
Planning Commission for such rezoning should be approved for the
reasons that such rezoning is in accord with good planning and with
the General Plan of the City of Yakima; that •the majority of property
owners in the vicinity do not oppose the change in classification;
that the needs of the City and community do require such change and
that the highest and best use of said property is for Planned Develop-
ment Zone, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of the
City of Yakima that the following described real property situated
at 55 •West Washington Avenue in the City of Yakima, Washington, and
more particularly described as follows, to wit:
Lots 9, 10, 11, 12, 13 and 14 of Phoebe D. Adams Subdivision
of the Northwest quarter of Section 31, Township 13 North, Range
19, E.W.M., also, all of the unplatted portion of the Southeast
quarter of the Northwest quarter of said Section 31, if any,
lying west of the following described tract of land.
Beginning at the center of said Section 31, thence west along
410 the subdivision line 702.7 feet; thence north 30 feet to an iron
pin; thence north 0 East 1303 feet to an iron pin; thence
east 681 feet; thence south 0 East 1334 feet to the point
of beginning, EXCEPT THAT part thereof lying west of the follow-
ing described line:
Commencing at the northwest corner of Lot 11 of said plat; thence
north 89 East along the north line of Lots 11, 10 and 9
of said plat 1605.00 feet to the point of beginning of said line;
thence South 1 East parallel with the west line of said
Lot 11 to the south line of Lot 14 of said plat and the terminus
of said line,
ALSO EXCEPT right-of-way for road along the south line thereof,

be rezoned from R-2, Two-Family Zone, to Planned Development Zone
be, and the same is hereby, approved and said real property is hereby
rezoned to a Planned Development Zone, all in accordance with, and
Al0 to conform to, the final development plan and program therefor approved
by the Yakima Planning Commission, a copy of which is attached hereto
and by reference made a part hereof.
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared by
and for the City.
Section 3. The City Clerk is hereby authorized and directed to
file with the Yakima County Auditor a certified copy of this ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided by
law and by the City Charter.
