HomeMy WebLinkAbout1976-1890 CONDEMNATION & ACQUISITION OF REAL PROPERTY FOR WIDENING & IMPROVING THE INTERSECTION OF 16TH AVENUE & TIETON ORDINANCE NO.} AN ORDINANCE authorizing and directing the City Attorney of the City of Yakima to institute and prosecute legal pro- ceedings for the condemnation and acquisition of real property for the widening and improving of the inter- section of 16th Avenue and Tieton Drive and for the installation of curbs, gutters, sidewalks, drainage facilities and public utility facilities related thereto; providing for the condemnation and taking of such real property and declaring the condemnation and taking thereof to be necessary for a public use required by the public interest; directing that com- pensation for such taking be paid from City Fund No. 142- Arterial Street Fund; and declaring an emer- gency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The City Attorney of the City of Yakima is hereby authorized and directed to institute and prosecute an action in the Superior Court of the State of Washington, in and for Yakima County, for the condemnation and acquisition of the hereinafter described real property for the widening and improving of the intersection of 16th Avenue and Tieton Drive, in the City of Yakima, Washington, . and for the installation of curbs, gutters, sidewalks, drainage facilities and public utility facilities related thereto, all in accordance with right -of -way drawings, consisting of two pages, for such improvement as prepared by the office of the Yakima City Engineer, copies of which drawings are attached to this ordinance and by reference made a part hereof; said real property is situated in the City of Yakima, Yakima County, Washington, and is more parti- cularly described as follows: PARCEL 11: That part of the following described parcel 5 -Y -1011 beginning at the NE corner of Lot 1, Block 1., of Hillcrest Addition to North Yakima (Now Yakima) recorded in Volume "B" of plats, page 104, records of Yakima, Wash - ington, thence southerly along the east lot line 7.82 feet, thence westerly to a point that is 19 feet westerly of the NE corner of Lot 1, along the North lot line and 4.8 feet southerly of the north lot line parallel with the east line of Lot 1, thence westerly to a point that is 67.7 feet westerly of the NE corner of Lot 1 along the North lot line and 2.7 feet southerly of the north lot line parallel with the east lot line, thence northerly parallel to the east lot line 2.7 feet to the north lot line, thence easterly along the north lot line the point of beginning. Parcel 5- Y1011. The east 67.7 feet of Lot 1, Block 1, AND The east 32 feet of the South 27.8 feet of the North 48 feet of Lot 2, Block 1, Hillcrest addition to North Yakima (now Yakima), recorded in Volume B of Plats, page 104, records of Yakima County, Washington. PARCEL 12: That part of the following described parcel 5 -Y -1012 beginning at the NW corner of Lot 1., Block 1., of Hillcrest Addition to North Yakima (Now Yakima) recorded in Volume "B" of plats, page 104, records of Yakima, Washington, thence easterly along the north lot line 62.3 feet, thence southerly parallel with the west line of said lot 2.7 feet, thence westerly to the point of beginning. Parcel 5- Y1012. The West 62.3 feet of Lot 1. and the East 32 feet of the North 20.2 feet of Lot 2, Block 1, Hillcrest Addition to North Yakima, now Yakima, Washington, recorded in Volume B of Plats, Page 104, records of Yakima County, Washington.., Section 2. The acquisition of said real property for the purposes herein mentioned is required for the interests of the • public and of the City of Yakima, and the uses and purposes herein mentioned do constitute a public use of said property, and said real property is necessary for the use and purposes mentioned herein.. Section 3. The compensation2for•2said real property to be taken shall be payable from Fund No. 142- Arterial Street Fund of the City of Yakima. Section 4. .In conducting said condemnation proceedings, the City Attorney is hereby authorized to stipulate to any matters for the purpose of minimizing damages. Section 5. This ordinance is one to provide for the immediate preservation of the public peace, property, health, safety and wel- fare of the people of the City of Yakima and an emergency isT hereby fit declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
