AN ORDINANCE relating to city government administration and per-
taining to city legal advertising; providing the
time and manner for calling for proposals and award-
ing a contract for city legal advertising; specify
ing requirements for the city legal newspaper;
repealing existing Chapter 1.75 of the City of Yakima
Municipal Code and re-enacting Chapter 1.75, and
various sections thereof, of the City of Yakima Muni-
cipal Code; and declaring an emergency.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Chapter 1.75, "Advertising Contracts", of the
City of Yakima Municipal Code, and Sections 1.75.010, 1.75.020,
1.75.030 and 1.75.040 thereof, are hereby repealed in their entirety.
Section 2. Chapter 1.75 of the City of Yakima Municipal Code,
and the following various sections thereof, are hereby enacted as
a new chapter and new sections of the City of Yakima Municipal Code,
which new chapter and sections shall be numbered and shall read as

"Chapter 1.75
LEGAL ADVERTISING CONTRACT
1.75.010 When awarded. The City Council shall
• award the contract for the city legal advertising annually
on the third Monday in February of each year in the
manner described in this chapter.
1.75.020 Council to •rescribe contract form--Date--
Call for bids Soecifications for cit newsoamer. The City
Council shall, on the first Monday in February of each year,
by resolution prescribe the form of contract for the print-
ing and publishing of city advertising for the ensuing
year, and the City Clerk shall then forthwith publish a
notice calling for sealed proposals for such contract in
two successive issues of the newspaper then publishing
the city advertising, which notice shall contain a general
statement of the terms of the contract to be awarded,
together with notification of the time and place of
411 public opening and reading of the sealed proposals;
provided, proposals will be accepted for publication
only in those newspapers posted as legal newspapers by
the Clerk of the Yakima County Superior Court accord-
ing to the provisions of R.C.W. 65.16.070, and provided
further, such proposals will be accepted for publication
only in those newspapers published within and having
general circulation within the City of Yakima.

Provided, the contract for city legal advertising
for the balance of the current 12 month period, ter-
minating in February, 1977, shall be awarded pursuant to
procedures prescribed by this chapter, with the resolution
prescribing the form of contract, the notice of call for
proposals therefor and the award of the contract to be
accomplished upon the enactment of this chapter, not-
withstanding the provisions of this chapter which other-
wise require those proceedings to occur during the month
of February of each year.
1.75.030 Opening proposals--Award of contract--
Rejection of bids.
A. At the time and place specified in the notice,
the City Clerk and Purchasing Agent of the City shall
publicly open the sealed proposals, shall tabulate the
results and make a recommendation to the City Council
as to the proposal which constitutes the lowest res-
ponsible proposal which complies with the requirements
of this chapter and with the published notice calling
for the sealed proposals.
B. At the regular City Council meeting on the
third Monday of February of each year, the City Council
shall consider such proposals and the recommendation
of the City Clerk and Purchasing Agent and shall, by
motion, accept the lowest responsible proposal which
complies with the requirements of this chapter and with
the published notice calling for the sealed proposals,
and shall award a contract therefor; provided, the City
Council may reject any and all proposals and direct
that a further call for proposals be published, accord-
ing to procedures prescribed by this chapter, until a
satisfactory proposal is received. Such further call
for proposals shall be published in the newspaper which
published the City's legal advertising for the previous
year.
1.75.040 Notification of award and execution of
contract. Upon the award of the contract by the City
Council as provided in Subsection 1.75.030 B of this
chapter, the Clerk shall forthwith notify the successful
bidder by mail, or in person, of the award of the contract
to that successful bidder who shall, within three days
from the date of such notification, execute a contract
in the form prescribed by the resolution adopted pursuant
to Section 1.75.020 of this chapter. In the event of
the failure or refusal of the successful bidder to execute
that contract, the City Council may award the contract
to the next lowest bidder."

Section 3. This ordinance is one to provide for the immediate
preservation of the public peace, property, health, safety and welfare
of the people of the City of Yakima and an emergency is hereby

declared to exist and this ordinance shall be in full force and
effect immediately upon its passage, approval and publication as
provided by law and by the City Charter.
