HomeMy WebLinkAbout1976-1940 REPEALING CHAPTER 12.48, “M-3, AIRPORT INDUSTRIAL ZONE”; ENACTING NEW CHAPTER 12.48, “M-3, AIRPORT ZONE”. - - ORDINANCE NO //254 AN ORDINANCE relating to zoning; repealing existing Chapter 12.48, "M-3, Airport Industrial Zone", of the City of Yakima, Municipal Code, and enacting a new Chapter 12.48, "M-3, Airport Zone", and various sections thereof, of the 4110 City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Existing Chapter 12.48 "M-3, Airport Industrial Zone", and all sections thereof, of the City of Yakima Municipal Code are hereby repealed. Section 2. Chapter 12.48 is hereby enacted as a new chapter of the City of Yakima Municipal Code, which new chapter, and the various sections thereof, shall be numbered and shall read as follows: "Chapter 12.48 M-3, Airport Zone 12.48.010 Purpose. The purpose of the Airport Zone (M-3) is to classify and set standards for those airport related and compatible uses capable of being located in and around the Yakima Air Terminal. Further, it is the intent of this chapter, and the Airport Zone (M-3), to protect the air space, airport development, and agricultural land related to the airport. 12.48.020 Criteria. The following general criteria are hereby established for use in the classification or re- classification of land to the Airport Zone: 1. General Plan - Compliance with General Plan and Yakima Municipal Airport Plan shall be established. 2. Location - Shall be that area as shown on the Yakima Municipal Airport Plan. 3. Utilities - The existing utilities systems (water, sewer, drainage, electrical, gas and communications facilities) are adequate or new systems will be constructed which will be adequate to serve an airport use. 12.48.030 Permitted Uses. A. In an M-3 Zone, no building shall be erected, recon- structed or structurally altered, nor shall any building or land be used for any purpose except as hereinafter provided and allowed by this chapter. All such uses shall be within an enclosed building unless specifically stated otherwise herein. B. In an M-3 Zone, the following uses only are permitted: 1. Agricultural uses. 2. Commercial aircraft services and transport. 3. Dwellings or shelters for the occupancy of guards, watchmen or caretakers, or dwellings or shelters for the occupancy of the operators and employees neces- sary for the operation of uses permitted in the M-3 Zone. 4. Manufacture, maintenance, operation and repair of aircraft. 4110 5. Manufacturing or processing of articles or products. 6. Retail uses and/or other uses incidental to the comfort and convenience of airport patrons, and/or employees. 7. Service and instructional uses. 8. Uses and/or devices necessary for the proper and safe operations of aircraft and/or airport facilities. 9. Warehousing or storage. 12.48.040 Development standards--Waiver. A. The following development standards shall apply to property zoned M-3, Airport Zone, unless a waiver of one or more of the stan- dards has been granted by the City Council, as provided by Subsection B of this section: 1. Precise Plan of Design. Any airport use application shall be accompanied by a precise plan of design showing its compatibility with the total airport environs. Said precise plan or design shall be reviewed by the Airport Manager and the Director of Community Development to insure compliance with this chapter. 2. Architectural Treatment. Examples of the architectural treatment in the form of at least one perspective and one elevation shall be submitted with any application for airport use and shall become an integral part of such appli- cation. 3. Underground Utilities. All utilities shall be underground. 4. Off-Street Parking. The provisions and requirements of Chapter 12.56, 'Off-Street Parking and Loading Regulations', of the City of Yakima Municipal Code shall be applicable to the M-3 Zone. 5.. Site Size. No airport site shall consist of less than 15,000 square feet of usable land. 6. Building Coverage. Building coverage of any airport use, 410 parcel or lot shall not exceed 50% of the parcel or lot. 7. Height Limit. Buildings within the Airport Zone shall have a maximum height no greater than dictated by the Yakima Municipal Airport Plan. 8. Storage. All storage of wares, merchandise, crates, bottles, or similar items shall be within a completely enclosed build- ing. (Excluding aircraft). -2- 10. Loading_ Facilities. All loading or unloading facilities shall be located at such a depth within a development as to reasonably contain and restrict any interference with normal aircraft and/or vehicular traffic. 11. Lighting. All lighting of the building, landscaping, parking lot, or similar facilities shall be so hooded 411IP • and directed as to reflect away from adjoining properties, taxiways and runways. 12. Mechanical Equipment. All ground mechanical equipment shall be completely screened behind a permanent structure and all roof top mechanical, equipment shall be placed behind a permanent parapet wall and be completely restricted from ground level view. 13. Signs. The following signs and conditions thereto will be allowed: a. Two square feet of advertising sign will be allowed on the front of a building for every lineal foot of building frontage. The maximum size of an advertising sign allowed in an M-3 Zone is 300 square feet, and no such sign need be less than 40 square feet, regardless of the lineal building frontage. b. One square foot of identifying sign will be allowed on the side or rear of a building for every lineal foot of building frontage when said side or rear is oriented to or faces a public parking area or street; provided, that no such sign shall exceed 150 square feet in size. B. A waiver of one or more of the development standards pres- cribed by Subsection A of this section may be granted by the City Council, after ,a public hearing by the Planning Commission and by the City Council on a request for such a waiver. A request for a waiver shall be made in writing and filed with the Office of Environ mental Planning of the City, which request shall specify the stan- dards for which a waiver is sought and the reason for the request. The Planning Commission shall hold a public hearing on such request, and make its recommendation to the City Council, whereupon the Council shall hold its public hearing and make its determination as to whether to grant all or any part of the request; and the City Council may impose conditions on any waiver it may grant. Notice of hearings by the Planning Commission and City Council on a request for a waiver under this section shall be given in the same time and manner as for a hearing on a rezone application." Section 3. This ordinance shall be in full force and effect thirty '‘Plys after its passage, approval and publication as provided by law and by the City Charter.
