AN ORDINANCE accepting the recommendation of the Planning Commis-
sion and rezoning property at the intersection of
48th Avenue and Tieton Drive from R-1, One-Family
Zone, to Planned Development Zone.
410 WHEREAS, by Ordinance No. 1944, dated, May 3, 1976, real
property described below was annexed to the City. of Yakima and
zoned R-1, One-Family Zone, in accordance, with Section 12.08.070
of the City of Yakima Municipal Code, and
WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held a hearing on the 17th day of May, 1976,
upon the recommendation of the Planning Commission that said real
property, the legal description of which is set out hereinbelow,
be rezoned from R-1, One-Family Zone, to Planned Development Zone,
and
WHEREAS, the City Council finds that such recommendation of
the Planning Commission for such rezoning should be approved for
the reasons that such rezoning is in accord with good planning and
with the General Plan of the City of Yakima; that the majority of
property owners in the vicinity do not oppose the change in clas-
sification; that the needs of the City and community do require
such change and that the highest and best use of said property
is for Planned Development Zone, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of
the City of Yakima that the following described real koperty
situated at the intersection of 48th Avenue and Tieton Drive in
III the City of Yakima, Washington, and more particularly described
as follows, to wit:
Beginning at the southwest corner of the northwest quarter
of the northwest quarter of Section 27, Township 13 North,
Range 18, E.W.M.; thence northerly along the west line of
said subdivision to the south right-of-way line of Tieton
Drive; thence easterly along said south right-of-way line
to the westerly line of the plat of Tri-Skool Addition, re-
corded in Volume "U" of Plats, page 4, records of Yakima
(3'e241-L"--9-‘)
County, Washington; thence southerly along said west line
to the south line of the northwest quarter of the north-
west quarter of Section 27, Township 13 North, Range 18, E.W.M.;
thence westerly along said line to the point of beginning,
be rezoned from R-1, One-Family Zone, to Planned Development Zone
be, and the same is hereby, approved and said property is hereby 410
rezoned to Planned Development Zone, all in accordance with, and to
conform to, the final development plan and program therefor approved
by the Yakima Planning Commission, a copy of which is attached here-
to and by reference made a part hereof.
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared by
and for the City.
Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this ordi-
nance.
Section 4. This ordinance shall be in full force and effect 410
thirty days after its passage, approval and publication as provided
by law and by the City
