ORDINANCE NO / AN ORDINANCE relating to zoning; prescribing use limitations appli- cable in B-3, General Business Zone; providing for the issuance of temporary use permits; amending Sec- . tions 12.36.020 and 12.60.040 of the City of Yakima Municipal Code; and declaring an emergency. 411 BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 12.36.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "12.36.020 Use regulations--Limitations. The following limitations shall apply in the B-3 Zone: 1. No privately owned dance hall, roller skating rink, ferris wheel, carnival or circus may be permitted within any public park, playground or schoolground. 2. No service station shall be permitted to be here after constructed within that portion of the central business district located within one block northerly or one block southerly of Yakima Avenue and west of Naches Avenue and east of Sixth Avenue, unless said service station is an accessory use to a parking lot having an area of not less than twenty-six thousand square feet. 3. Lighting for all permitted uses shall be so arranged as to reflect the light away from the adjoining residential premises. In addition, said lights shall be so arranged so as not to interfere With the safe operation of motor vehicles." Section 2, Section 12.60.040 of the City of Yakima Municipal Code is hereby amended to read as follows: "12.60.040 Issuance of temporary use permits. The City Council may issue temporary use permits for the following uses: 1. The erection and use in an undeveloped residence zone of bunkers or other equipment for the handling and removal from the premises of sand, gravel, or other deposits of commercial value, provided that no permit shall be issued for a period of more than one year. 2. One temporary real estate office and one temporary 410 real estate billboard not to exceed fifty square feet in area may be located in any zone, provided that such office and billboard if located in an R zone shall be removed at the end of two years from the date of the recording of the map of the sub- division upon which said office and billboard are located. 3. Temporary structures for the housing of equipment or containing supervisory offices in connection with major construction projects may be established and maintained during the progress of such construc- tion projects, provided that such temporary structure may not be maintained for a period exceeding one year except by permission of the City Council who may extend this period for one additional year. 4. Circuses and carnivals, provided the premises are 410 occupied for such purposes not more than once for not more than one week in any six months period." Section 3. This ordinance is one to provide for the immediate preservation of the public peace, prop?rty, health, safety and wel- fare of the people of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter. ,) X/ PASSED BY THE CITY COUNCIL, signed and approved this //,/ -- day of Id' 1976. 4 Mayor ATTEST: y Clerk -2-
