AN ORDINANCE providing for the vacation of a portion of public
street in the City of Yakima, Washington.
WHEREAS, a petition has been filed with the City Council
of the City of Yakima requesting the vacation of the hereinafter
described portion of public street, and
WHEREAS, a hearing by the City Council was duly held on
said petition, and as a result of such hearing the City Council
finds it to be in the best interests of the City of Yakima that
said petition be granted and that said portion of street be
vacated, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The following described portion of street in
the City of Yakima, Washington, to-wit:
West Spruce Street from the west right-of-way line on
Fifth Avenue to the west right-of-way line on Sixth Ave-
", nue except the northerly 40 feet of the easterly 160 feet,
be, and the same is hereby, vacated.
Section 2. The City of Yakima hereby reserves all necessary
easements and rights-of-way for the installation and maintenance'
of any and all water mains, sewers or utilities of any and all
kinds which may now exist in said alley or which it may hereafter
desire to construct therein, and no building shall be constructed
on any portion of said vacated alley without the prior approval
of the City.
Section 3. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
