AN ORDINANCE providing for the vacation of air space above a por-
tion of East Yakima Avenue within the City of Yakima,
Washington.
WHEREAS, a petition has been filed with the City Council of
411 the City of Yakima requesting the vacation of the hereinafter des-
dribed air space above a portion of East Yakima Avenue, and
WHEREAS, a hearing by the City Council was duly held on said
• petition, and as a result of such hearing the City Council finds it
to be in the best interests of the City of Yakima that said petition
be granted and that said air space be vacated, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The air space above a portion of East Yakima
Avenue described as follows:
Air space above the follpwing described public right-of-way
from 1088 feet Mean Sea level to 1138 feet Mean Sea level
according to City of Yakima elevation datum.
111 Beginning at the Southwest corner of Lot 16, Block 110, Town
of North Yakima (now Yakima), according to the official plat
thereof as recorded in Volume A of plats, page 10, and re-
recorded in Volume E of plats, page 1, records of Yakima
County, Washington; thence Easterly along •the SouthJine of
said Lot 16 to the Southeast corner of said Lot 16; thence
Southerly along the East line of said Lot 16 extended a
distance of 9.00 feet; thence Westerly parallel with the South
line of said Lot 16 to the West line of said Lot 16 extended;
thence Northerly along the West line of said Lot 16 extended
to the point of beginning;
all as depicted on a drawing constituting EXHIBIT A, page 2, to the
petition to vacate on file in the office of the Yakima City Clerk,
Yakima City Hall, Yakima, Washington, be, and the same is hereby,
vacated, subject to the following conditions:
1. By the acceptance of this vacation, the Young Men's
Christian Association of Yakima, present owner of the
space to be vacated, must waive and release any claim
against the City of Yakima for light or light reflection
that might arise because of the proximity of street
lights that might be installed near a structure to be
placed in the vacated area.
2. In the event of demolition or other destruction of any
• structure placed in the vacated area, and in the further
event of a sale or similar change of ownership after
such demolition or other destruction rendering the
vacated area no longer necessary for Young Men's
Christian Association of Yakima use, the vacated area
shall thereupon revert to the City of Yakima.
Section 2. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this 29th
day of July, 1974.
