AN ORDINANCE relating to zoning; enacting offstreet parking and
loading regulations for various land use categories;
amending Sections 12.56.010, 12.56.020, 12.56.030,
12.56.040, 12.56.050, 12.56.060, 12.56.070, 12.56.080,
12.56.090, 12.56.100 and 12.56.110, and enacting Sec-
tions 12.56.120 and 12.56.130 as new sections, all of
the City of Yakima Municipal Code.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 12.56.010 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"12.56.010 Purpose. The purpose of this chapter and
the parking regulations contained herein—are:
1. To prevent the worsening of an existing serious
deficiency of parking facilities throughout the
city.
2. To require the provision of offstreet parking faci
lities for all land use categories, defined in Sec-
tion 12.56.040 of this chapter, within the city.
3. To reduce the amount of on-street storage of vehicles
so as to increase the safety and capacity of the
city's street system.
4. To improve the physical environment of the city
through adequately landscaping parking areas."
Section 2. Section 12.56.020 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"12.020 Offstreet parking spaces to be provided. When
a new building is constructed, or when, the use category of
an existing building is changed, offstreet parking and load-
ing spaces shall be provided according to the standards set
forth in Section 12.56.040 of this chapter. When a building,
existing at the effective date of this chapter, is enlarged
so as to require additional parking spaces to conform to
requirements of this chapter, such additional parking spaces
shall be provided; however, the number of such additional
• spaces shall be computed with regard only to the extent of
the enlargement, regardless of whether or not the number of
previously existing spaces satisfies requirements of this
chapter."
110 Section 3. Section 12.56.030 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"12.56.030 General Provisions. A. It shall be a con-
tinuing obligation of the owner of property, for which parking
spaces are required by this chapter, to provide the required
offstreet parking and loading facilities. Building permits
or other permits will be issued only after receipt by the
Chief Building Official of site plan drawn to scale showing
the location of permanent parking and loading facilities.
B. Required parking spaces shall be available for
parking of vehicles of residents, customers, patrons and
employees only, as the case may be, and shall not be used
411 for storage of vehicles or materials or for the parking
of vehicles used in conducting the business or use to
which the property is put, and shall not be used for the
sale, repair or servicing of any vehicle.
C. Offstreet parking and loading facilities shall be
provided prior to occupancy of any structure hereafter built
or enlarged, or prior to a change in the category of use
of any land. No certificate of occupancy will be issued
until the requirements of this chapter are satisfied.
D. Any use of property which, on the effective date
of this chapter or any amendments hereto, is nonconforming
as to the regulations relating to offstreet parking facili-
ties may continue to be used in the same manner as if the
parking facilities were conforming. Such existing parking
facilities shall not be further reduced.
E. Offstreet parking spaces existing on the effective
date of this chapter and actually being used for the parking
of automobiles or other motor vehicles in connection with
the use of an existing building shall not be reduced in
number or size during the entire life of such building or
• land use below that which would be required for a new build-
ing or land use of a similar type constructed or commenced
after the effective date of this chapter.
F. The required front yard in the R-M and R-3 zones
shall not be utilized for offstreet parking unless the three
foot strip nearest the front property line is landscaped and
a two foot high concrete, masonry, or decorative block wall
or wood fence or solid landscaping screen, is provided."
Section 4. Section 12.56.040 of the City of Yakima Municipal
Code is hereby amended to read as follows
"12.56.040 Use categories--Parking spaces required.
A. The number of offstreet parking spaces required for various
use categories shall be not less than as provided in the follow-
ing schedule, respectively:
1. Residential Uses
One family dwelling 2 spaces for each dwelling unit
Mobile homes 2 spaces for each dwelling unit
Trailer courts 1 space for each trailer unit
Two family or multiple ) Duplex - 4 spaces
family dwellings ) Triplex - 5 spaces
) Fourplex - 7 spaces
) Fiveplex - 8 spaces
) Six or more units - IA spaces for
each dwelling unit

Requirements for a building or use not specifically
listed in this schedule shall be determined by the
Chief Building Official, based upon the requirements
of similar uses.
B. Computation of required spaces. In computing the
the number of required or available spaces to determine com-
pliance with requirements of this section, the following
means of computation shall be applied:
I. Computation of required spaces. When a building or
use is planned or constructed in such a manner that
a choice of parking requirements could be made, the
use which requires the greatest number of parking
spaces shall govern.

2. Fraction. If the number of offstreet parking spaces
required contains a fraction, such number shall be
changed to the nearest higher whole number.
3. Mixed uses. When several uses occupy a single struc-
ture or lot, the total required parking spaces shall
be the sum of the requirements of the individual uses.
4. Dual uses. None of the provisions of this chapter
shall be construed or applied so as to prevent the
dual use of parking facilities for the times during
which uses are not conflicting. For the purpose of
computing the number of parking spaces available
through the dual use of parking facilities, the follow-
ing considerations, rules and regulations shall be
applied:
(a) The building or use for which application is made
for authority to utilize existing offstreet park-
ing facilities provided by another building or
use shall be located within 300 feet of such
parking facilities.
(b) The applicant shall show that there is no substan-
tial conflict in the principal operating hours
for the buildings or uses for which the dual use
of offstreet parking facilities is proposed.
(c) Parties concerned in the dual use of offstreet
parking facilities shall file in the office of
Code Enforcement written evidence of an agreement
for such dual use.
(d) Up to 50% of the parking facilities required by
this chapter for a use considered to be primarily
a daytime use may be provided by a use considered
to be primarily a nighttime use; up to 50% of the
parking facilities required by this chapter for
a use considered to be primarily a nighttime use
may be provided by a use considered to be primarily
a daytime use; provided, up to 100% of the parking
facilities required by this chapter for a church
or for an auditorium incidental to a public or
parochial school may be supplied by parking faci-
lities of a use considered to be primarily a day-
time use. For purposes of this subsection, and
as a standard for applying the provisions of this
section, the following uses are considered to be
primarily daytime uses: banks, business and
financial offices, manufacturing uses, and the
following uses are considered to be typical night-
• time and/or Sunday uses: auditoriums, incidental
to a public or parochial school, churches, dance
halls and theatres."

Section 5. Section 12.56.050 of the City of Yakima Municipal
Code is hereby amended to read as follows!
"12.56.050 Access to required spaces. All offstreet
parking spaces shall be provided with adequate ingress and
egress. Parking spaces in tandem having a single means of
411 ingress and egress shall not be counted as two offstreet
parking spaces for the purpose of fulfilling the require-
ments of this chapter; provided, each tandem space in a
one family dwelling use category, as specified in Section
12.56.040 of this chapter, shall be counted as a required
parking space."
Section 6. Section 12.56.060 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"12.56.060 Parking layout standards. Access aisles and
parking stalls shall be of sufficient width and length to pro-
vide for all turning and maneuvering, and shall conform to
the following schedule of minimum dimensions:

Section 7. Section 12.56.070 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"12.56.070 Location of required spaces. A. Groups of
five or more parking spaces shall be served by a driveway so
that no vehicular backing or other maneuvering movement will
• occur within a public right-of-way other than an alley.
B. Required offstreet parking for single family, two
family and multiple family dwellings shall be located on,
or within 65 feet of, the lot or building site of the build-
ing
to be served by the parking spaces.
C. Offstreet parkii=lz area for non-residential uses shall
be located not more than 300 feet from the structure or use
served.
Section 8. Section 12.56.080 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"12.56.080 Required improvement and maintenance of park-
ing areas and car sales area. Every new lot or parcel of land
used as a public or private parking area and having a capacity
of three or more vehicles, or a car sales area, shall be
developed and maintained so as to meet the following specifica-
tions:
1. Surfacing. New offstreet parking areas and car sales
areas shall be paved with two inch thick asphaltic surfac-
ing on aggregate base or equivalent surfacing acceptable
to the City so as to eliminate dust or mud and shall be
graded and drained so as to dispose of all surface water.
Grading and drainage facilities shall be arranged so that
no water drains across sidewalks.
2. Border baricades and screening.
(1) Any parking areas and car sales areas that are
not separated by a fence from any street property line upon
which it abuts shall be provided with a suitable concrete
curb or timber barrier not less than six inches in height
and located not less than two feet from the street property
line. Such curb or barrier shall be securely installed
and maintained; provided, no such curb or barrier shall
be required across any driveway or entrance to the parking
area.
(2) Every parking area or car sales area abutting
V /property located in any "ROzone shall be separated from
such property by a solid masonry wall or wood fence,
• which wall or fence shall be four to six feet in height;
provided, that along the required front yard the wall
shall not exceed two feet in height. No such wall need
be provided where the elevation of that portion of the
parking area immediately adjacent to an "R" zone is six
feet or more below the elevation of such zoned property
along the commoni)roperty line."

Section 9. Section 12.56.090 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"12.56.090 Required landscaping of parking areas.
A. A minimum of 4% of the total area to be devoted to parking,
in parking lots of five or more spaces, shall be landscaped.
On premises used for an industrial use category, as specified
in Section 12.56.040 of this chapter, the landscaping required
by this section shall apply only to parking areas abutting on
a public right-of-way.
B. No required planting area shall be less than 24 square
feet in area with the exception of raised planter boxes around
or in close proximity to buildings.
C. An average of at least one tree selected from a list
provided by the Office of Environmental Planning shall be
installed for every 15 single row parking stalls or every 30
double row parking stalls within the parking lot.
D. Landscaping shall consist of combinations of trees,
shrubs, and ground cover with careful consideration to eventual
size and spread, susceptibility to disease and pests, durability
and adaptability to existing soil and climatic conditions."
Section 10. Section 12.56.100 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"12.56.100 Lighting. Lighting, if provided, shall be
indirect, hooded and arranged to reflect away from adjoining
properties and streets."
Section 11. Section 12.56.110 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"12.56.110 Plot plan required. A plot plan of every new
or enlarged offstreet parking lot and new car sales area shall
be filed with the Office of Code Enforcement prior to the com-
mencement of construction thereof. The plan shall be drawn to
a minimum scale of 1 inch for each 50 feet, and shall clearly
indicate the proposed development, including locations, size,
shape, design, curb cuts, lighting, landscaping, irrigation and
other features and appurtenances of the proposed parking lot."
Section 12. Section 12.56.120 is hereby enacted as a new sec-
tion of the City of Yakima Municipal Code to read as follows:
• "12.56.120 Downtown business district exempt. The down-
town business district, as defined on the attached Plate 10,
hereby adopted as a part of this chapter, shall be exempt from
the provisions of this chapter as they relate to the number
of parking spaces required, however, all other requirements
of this chapter shall apply to such downtown business district."

Section 13. Section 12.56.130 is hereby enacted as a new
section of the City of Yakima Municipal Code to read as follows:
"12.56.130 Existing uses. The provisions and require-
ments of this chapter shall not apply to uses of property
II/ and parking lots or spaces existing on the effective date
of this chapter; provided, the provisions and requirements
of this chapter shall apply to new construction, to changes
of a use category of existing premises, and to the develop-
ment of premises, subsequent to the effective date of this
chapter."
Section 14. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
