ORDINANCE NO. /7_..?C AN ORDINANCE relating to licenses and business regulations; pro- hibiting the operation of billiard or pool tables for hire without a license and specifying the fee therefor; specifying the procedures for applying for such license, prohibiting license transfer, and providing for license revocation; prohibiting • admission of minors to premises where alcoholic beverages are sold; and amending Sections 5.18.010, 5.18.020, 5.18.030, 5.18.040, 5.18.050 and 5.18.070 and repealing Section 5.18.060, all of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 5.18.010 of the City of Yakima Municipal • Code is hereby amended to read as follows: "5.18.010 License required. It shall be unlawful for any person, firm or corporation to operate one or more billiard tables or pool tables for hire within the City of Yakima without first obtaining a license and paying the fee therefor as required by this chapter." Section 2. Section 5.18.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.18.020 Fees. The license fee for each billiard table or pool table shall be the amount of Thirty-five Dollars per annum, payable annually in advance to the City Clerk at the time application is made for such license." Section 3. Section 5.18.030 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.18.030 Application for license. Any person, firm or corporation desiring to obtain a license to open and con- duct any billiard hall or pool hall shall make application therefor in writing to the City Clerk on forms specified by the City, which application shall name the owner of the busi- ness, the operator of the business premises and the address where the business is to be conducted. If the application is in due form and if the applicant is deemed to be a suitable person to conduct the business for which such license appli- cation is made, the City Clerk shall issue the license." Section 4. Section 5.18.040 of the City of Yakima Municipal. Code is hereby amended to read as follows: "5,18.040 Assignment of license prohibited. No license granted under the provisions of this chapter shall be assignable or authorize the operation or conducting of any billiard hall or pool hall in any other place or by any other person than specified in the license." Section 5. Section 5.18.050 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.18.050 Revocation -- Conducting business without license. All licenses issued pursuant to this chapter may be revoked by the City Manager of the City of Yakima for the violation of any provisions of this or any other pro- vision of the City of Yakima Municipal Code applicable to, the business for which a license is issued, or for any other cause which shall be deemed sufficient by him. Any person, firm or corporation conducting or operating any billiard table or pool table for hire for which a license is required by this chapter, after notice of such revocation, shall be liable to the penalties herein provided as for conducting such business without a license." Section 6. Section 5.18.070 of the City of Yakima Municipal Code is hereby amended to read as follows: "5.18.070 Minors. It shall be unlawful for any person, firm or corporation owning, keeping or managing a billiard room or pool room to admit thereto or to allow to remain therein any person under the age of twenty -one years where such billiard room or pool room is operated in connection with any place where beer, wine or intoxicating liquor is sold, or where there is a common entrance to such billiard room or pool room and to any place where beer, wine or • intoxicating liquor is sold, or where there is any connect- ing door or window between such billiard room or pool room , and any place where beer, wine or intoxicating liquor is sold." Section 7. Section 5.18.060 of the City of Yakima Municipal Code is hereby repealed in its entirety. Section 8. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
