AN ORDINANCE authorizing and directing the City Attorney of the
City of Yakima to institute and prosecute legal pro-
ceedings for the condemnation and acquisition of
real property for the widening and improving of the
intersection of West Lincoln Avenue and Pierce Ave-
1110 nue and for the installation of curbs, gutters, side-
• walks, drainage facilities and public utility facili-
ties related thereto; providing for the condemnation
and taking of such real property and declaring the
condemnation and taking thereof to be necessary for
a public use required by the public interests; and
directing that the compensation for such taking be
paid from the Urban Arterial Fund of the City of
Yakima; and declaring an emergency.
BE IT ORDAINED BY THE CITY OF YAKEAA:
Section 1. The City Attorney of the City of Yakima is hereby
authorized and directed to institute and prosecute an action in
the Superior Court of the State of Washington, in and for Yakima
County, for the condemnation and acquisition of the hereinafter
described real property for the widening and improving of the
II/ intersection of West Lincoln Avenue and Pierce Avenue in the City
of Yakima, Washington, and for the installation of curbs, gutters,
sidewalks, .drainage facilities and public utility facilities related
thereto, all in accordance with plans for such improvement project
as depicted on a drawing prepared by the office of the Yakima City
Engineer, a copy of which drawing is attached to this ordinance
and by reference made a part hereof, said real property being
situated in the City of Yakima, Yakima County, Washington, and
being legally described as follows:
Beginning at the Northeast corner of Block 2 of TENNANT &
MILES MODERN ADDITION to North Yakima (now Yakima), recorded
in Volume "A" of Plats, page 98, records of Yakima County,
Washington; thence Westerly along the North line of said
Block 2 a distance of 48.5 feet; thence Southerly parallel with
the East line of said Block 2 a distance of 1 foot; thence
Easterly and Southerly along the arc of a curve to the right
having a radius of 44.5 feet to a point that is 45.5 feet
Southerly of the North line and 4 feet Westerly of the East
line of said Block 2; thence Easterly parallel with the West
line of said Block 2 a distance of 4 feet; thence Northerly
along the East line of said Block 2 a distance of 45.5 feet
to the point of beginning.
Section 2. The acquisition of said real property for the pur-
poses herein mentioned is required for the interests of the public
and of the City of Yakima, and the uses and purposes herein mentioned
do constitute a public use of said property, and said real property
•
is necessary for the use and purposes mentioned herein.
Section 3. The compensation for said real property to be taken
shall be payable from the Urban Arterial Fund of the City of Yakima.
Section 4. In conducting said condemnation proceedings, the
City Attorney is hereby authorized to stipulate to any matters for
the purpose of minimizing damages.
Section 5. This ,ordinance is one to provide for the immediate
preservation of the public peace, property, health, safety and wel-
fare of the people of the City of Yakima and an emergency is hereby
declared to exist and this ordinance shall be in full force and effect
immediately upon its passage, approval and publication as provided by
• law and by the City Charter.
