AN ORDINANCE providing for the vacation of a portion of public
street in the City of Yakima, Washington.
WHEREAS, a petition has been filed with the City Council of
the City of Yakima requesting the vacation of the hereinafter des-
",
cribed portion of public street, and
WHEREAS, a hearing by the City Council was duly held on said
petition, and as a result of such hearing the City Council finds
it to be in the best interests of the City of Yakima that said
petition be granted and that said portion of street be vacated, now,
therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The following described portion of street in the
City of Yakima, Washington, to-wit:
That part of Sycamore Avenue lying north of Lot 14 of
Philips Suburban Tracts, records of Yakima County, Washington,
between the east right-of-way line on North 1st Street and
the west right-of-way line on North 2nd Street,
be, and the same is hereby, vacated.
Section 2. The City of Yakima hereby reserves all necessary
easements and rights of way for the installation and maintenance of
any and all water mains, sewers or utilities of any and all kinds
which may now exist in said street or which it may hereafter desire
to construct therein, and no building shall be constructed on any
portion of said vacated street without the prior approval of the
City.
Section 3. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.

THIS INDENTURE WITNESSETH: That Richard D. Smith, General
Manager and Agent for Tod E. McCluske and Edward H. Pietz;
a partnership doing business as Garden Villa Motor Inn,
Grantor, for and in consideration of One Dollar ($1.00) and
other valuable consideration, the receipt of which is hereby
acknowledged, hereby conveys and warrants to the City of
Yakima, Washington, a municipal corporation, the following
described real estate situate in the City of Yakima, Yakima
County, Washington, to-wit:
The south 25 feet of Lot 14, Philips Suburban Tracts,
recorded in Volume "I" of Plats, page 12, records of
Yakima County, Washington.
IN WITNESS WHEREOF, grantor has hereunto set his hand
and seal this Mk, day of December, 1974.
