AN ORDINANCE accepting the recommendation of the Planning Com-
mission and rezoning property at 3800 Summitview
from R-3, Multiple Family Zone, to Planned Develop-
ment Zone.
WHEREAS, pursuant to due and legal notice, the City Council
410 of the City of Yakima held a hearing on the 23rd day of Decem-
ber, 1974, upon the recommendation of the Planning Commission
that real property situated at 3800 Summitview Avenue in the
City of Yakima, Washington, the legal description of which is
set out hereinbelow, be rezoned from R-3, Multiple Family Zone,
to Planned Development Zone, and
WHEREAS, the City Council finds that such recommendation
of the Planning Commission for such rezoning should be
approved for the reasons that such rezoning is in accord with
good planning and with the General Plan of the City of Yakima;
that the majority of property owners in the vicinity do not
oppose the change in classification; that the needs of the City
and community do require such change and that the highest and
best use of said property is for Planned Development Zone, now,
therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission
of the City of Yakima that the following described real property
situated at 3800 Summitview Avenue in the City of Yakima, Wash-
ington, and more particularly described as follows, to wit:
PARCEL A:
Beginning at the north line of Summitview Avenue 663
feet east of the north and south centerline of Section
22, Township 13 North, Range 18, E.W.M.; thence north
163.1 feet more or less to the southwesterly line of
the Yakima Valley Canal; thence southeasterly along the
southwesterly line of said canal to the north line of
Summitview Avenue; thence west along said north line
132.5 feet to the point of beginning.
PARCEL B:
Beginning at a point situate 562.5 feet East of the center
of Section 22, Township 13 North, Range 18, E.W.M.; thence
East 100.5 feet; thence North 163.1 feet to the South
right-of-way line of Yakima Valley Canal Company's canal;
thence following said right-of-way line North 39 West

25.8 feet; thence North 47 West 81.3 feet; thence
North 26 West 53.5 feet; thence South 285.3 feet to
the point of beginning;
LESS the South 30 feet thereof for road; and
EXCEPT the West 30 feet thereof;
be rezoned from R-3, Multiple Family Zone, to Planned Development
410 Zone be, and the same is hereby, approved and said real property
is hereby rezoned to a Planned Development Zone, all in accordance
with, and to conform to, the final development plan and program
therefor approved by the Yakima Planning Commission, a copy of which
is attached hereto and by reference made a part hereof; provided,
the effectiveness of this rezone is subject to the following con-
ditions:
1. Irrigation and drainage plan for the planned development
to be submitted to staff prior to building permit issuance.
2. 10 feet of deeded right of way along the applicant's south
property line to be used for a five foot side walk and
associated planter strip.
• 3. Installation of the sidewalk and street trees at the
owner's expense under City supervision and specification.
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared
by and for the City.
Section 3. The City Clerk is hereby authorized and directed to
file with the Yakima County Auditor a certified copy of this ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.

b. 1. From our knowledge of present senior citizen projects in Yakima
we recognize that thereis a continuing need for high quality and
moderate cost housing especially suited for this age group, The
market survey recently done by the Yakima Planning Department under-
scores our belief that a project such as we are planning would meet
i d. with rapid acceptance from those people who stand to benefit from
its availability.
We feel that the concept of planned retirement in a project
such as this with its location so near to 24 hour health care,
shopping center, drug stores, food market, bus, etc would be an
exciting addition to Yakima,
2. Proposed ownership will either be a partnership of Gary Fresk
and Virgil Cumbo or a sole ownership by the Living Care Centers-
Summitview Manor. They have expressed an interest in buying the
building after it is constructed,
3. Operation of the building will either be done by a manager/
maintenance person hired by the owners or in the case of a lease/sale
to Living Care Centers, they will include the building in their
present operation. In any event, the building will be provided with
a full time system of maintenance so as to give the tenants the
most in a trouble-free environment.
4. Waste will be handled by the City of Yakima
5. Power will be supplied by Pacific Power and Light.
6. Water is from City of Yakima.
7. Public transportation is available on the city bus lines
which pass directly in front of the proposed building.
0 8. Facilities near-by include the following: Summitview manor
for 24 hour access to medical attention; Westpark shopping
center with its food store, drug store, and complete range of
small shops; medical and dental centers within easy walking
distance;
9. The proposed timetable of development and construction calls
for the following schedule:
.January 1, 1975 - d?.molition and/or removal of present buildings
February 1 site preparation (weather permitting)
March 1 start of construction
October 1 finish of project and renting of apartments
