AN ORDINANCE pertaining to City personnel; defining the content of the classification and compensation plan; specifying the work week, vacation accrual provisions and leave of absence provisions for certain City employees; amend- ing Sections 2.20.020:,2.22.010, 2.22.030, 2.40.020 111 and 2.40.060 and Subsections 2.20.088 (d) and 2.20.088 (g), all of the City of Yakima Municipal Code; and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 2.20.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "2.20.020 Content of plan. The classification and com- pensation plan shall include: 1. The basic salary schedule as set forth in this chap- ter, and subsequent amendments and additions thereto, 2. A schedule of salary ranges consisting of minimum and maximum rates of pay for each management position and minimum and maximum rates of pay, together with intermediate steps, for all other classes of positions included in the city classification plan as set forth in this m chapter, and subsequent amendments and addi- tions thereto, 3. The annual budgets prescribed by the laws of the State of Washington." Section 2. Subsection 2.20.088 (d) of the City of Yakima Muni- cipal Code is hereby amended to read as follows: "2.20.088 Uniform allowance--Special assignment pay. (d) Police officers shall be paid Thirty Dollars per month in addition to their regular salary when assigned the duties of administrative assistant to the Chief of Police." Section 3. Subsection 2.20.088 (g) of the City of Yakima Muni- cipal Code is hereby amended to read as follows: "2.20.088 Uniform allowance--Special assignment pay. (g) When any member of the Police Department is assigned by the Chief of the department to a position which requires operation of a motorcycle, such member shall be paid Twenty-five Dollars per month, in addition to his regular salary, for each month that he operates •a motorcycle more than fifty percent of his total duty time." Section 4. Section 2.22.010 of the City of Yakima Municipal Code is hereby amended to read as follows: "2.22.010 Maximum work week. Firemen on shift schedules shall be required to work a maximum average of fifty-six hours per week based on a twenty-seven day work period with a mini- mum of one day off per week." Section 5. Section 2.22.030 of the City of Yakima Municipal 11, Code is hereby amended to read as follows: "2.22.030 Time off privileges. A. Vacation and holidays specified. All firemen, regularly employed as such, shall be granted time-off privileges as follows: 1. Vacation Leave. (a-) After one years' service firemen shall be eligible for five days of vacation leave per year with pay. The term 'day' wherever used in regard to firemen shall mean one twenty-four hour working day as the same is used with respect to the employees of the Fire Department; it being understood that all firemen work for a period of twenty-four hours and are then off for a period of forty-eight hours. (b) After ten years of continuous service, firemen shall be eligible to seven days vacation leave with pay for each year worked thereafter. (c) Vacation leave shall accrue from the date 111 of employment but shall not be available until the completion of one year of service. The same regulations shall apply to the scheduling and granting of vacation leave as established in Section 2.40.020 (d) of this code for other city employees insofar as the same are applicable. 2. Holidays. Firemen shall be entitled to four days off with pay per year in lieu of holidays. Such time off with pay in lieu of holidays shall be scheduled so as to meet the operating requirements of the Fire Department, and, insofar as may be prac- ticable, the preference of the members. B. Vacation and holiday accrual. Unused vacation and holiday leave may accrue to a maximum of fourteen days. C. Day men and alarm operators. All members of the Fire Department working straight day shifts and alarm operators shall be entitled to sick leave and holiday time off which shall be computed on the same basis as for the other employees in the City working on a forty-hour week basis. Vacation 411 leave shall be computed according to provisions of Section 2.40.020 of this chapter." Section 6. Section 2.40.020 of the City of Yakima Municipal Code is hereby amended to read as follows: -2- "2.40.020 Vacation leave. A. Rate of accrual of vaca- tion leave. (1) Commencing July 1, 1971, each eligible employee shall earn vacation leave at the rate of six and seven-tenths hours vacation for each full calendar month of service. (2) Commencing January 1, 1975, each eligible employee with three or more years of continuous service shall earn vaca- tiondeave at the rate of 8 hours vacation for each calendar month of service; provided, the provisions of this paragraph shall not apply to the Fire Marshal, Assistant Fire Marshal, Fire Inspectors and members of the Fire Department not covered by the L.E.F.F. Pensibn Plan who shall earn vacation leave at the rate of 8 hours vacation for each calendar month of service after 5 years of continuous service. (3) Commencing January 1, 1975, each eligible employee with 10 or more years of continuous service shall earn vacation leave at the rate of 12 hours vacation for each full calendar month of service; provided, the provisions of this paragraph shall not apply to the Fire Marshal, Assistant Fire Marshal, and members of the Fire Department not covered by the L.E.F.F. Pension Plan who shall earn vacation leave at the rate of 10 hours of vacation for each calendar month of service after 10 years of continuous service. B. Accumulation of vacation. Commencing January 1, 1973, vacation leave may be accumulated not to exceed two hundred forty hours. C. Permissible use of vacation accruals with pay. (1) Vacation leave accumulated at the end of six months of service may be taken in the seventh month and each month thereafter as accumulated. (2) Vacation leave must be taken at such time as the employee can be spared, but an employee will be allowed to take his leave when he desires if it is possible to schedule it at that time. (3) All vacation leave must be requested in advance and approved by the employee's department head. D. Terminal leave. (1) A permanent employee, when leaving the service of the City in good standing and who has given at least two weeks! notice of his intention to leave, shall be compensated for vaca- tion leave earned and accumulated to the date of separation. 41/ (2) No compensation for vacation leave shall be payable to any employee who terminates his employment or is terminated before he has completed six months of service. (3) Any eligible employee who is discharged or resigns as a result of disciplinary action shall be entitled to be compen- sated for only that vacation leave which was earned in preceding -3- .. . . • . . calendar years and not used at time of separation. This pro- vision also shall apply to employees who quit without giving the notice specified in (1) above. (4) Terminal leave shall be computed by multiplying the daily rate in effect at the time of termination (monthly salary times .046) by the number of days accumulated. AO E. Reporting. Vacation leave with pay shall be reported to the personnel department on forms and according to procedures as specified by the director of personnel." Section 7. Section 2.40.060 of the City of Yakima Municipal Code is hereby amended to read as follows: "2.40.060 Leave without pay. A. All leave without pay must be requested and approved by the department head prior to the beginning date of such leave. B. Leave wihout pay for more than fifteen working days must be approved in advance by the appointing authority. C. Leave without pay shall be provided female employees for childbirth provided that such leave requests conform with A and B of this section. In addition, a written recommendation by the employee's doctor shall be provided which states the final date which the employee may work. The employee may return to work when she is able with her doctor's consent. Such leave III without pay shall not extend beyond 12 weeks." Section 8. This ordinance is one to provide for the immediate preservation of the public peace, property, health, safety and wel- fare of the people of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
