ORDINANCE NO. /74d AN ORDINANCE relating to building regulations; amending the Uniform Mechanical Code of the City of Yakima; authorizing the issuance of permits to designated classes of persons; defining terms; prohibiting the engaging in business as a heating and/or comfort cooling contractor without a state certificate of registration; amending Sections 11.32.050, 11.32.080 and 11.32.090, and repealing Sections 11.32.100 and 11.32.110 of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 11.32.050 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.32.050 Amendment to Section 302. Section 302 of the Uniform Mechanical Code adopted by this chapter is amended by adding thereto a new subsection numbered 302(d), which new subsection shall read as follows: 'Subsection 302 (d) To Whom Permits May Be Issued. (1) A permit may be issued to a properly licensed person, firm or corporation not acting in violation of any current contractors law. (2) Any permit required by this code may be issued to any person to do any work regulated by this code in a single family dwelling used exclusively for living purposes, includ-. ing the usual accessory buildings and quarters in connec- tion with such buildings, in the event that such person is the bona fide owner of any such dwelling and an accessory building and quarters, and that the same are occupied by said owner, provided, that owner shall personally purchase all materials and shall personally perform all labor in connection therewith. (3) No permit shall be issued to any person to do or cause to be done any work regulated by this code except to a person holding a valid unexpired and unrevoked heating and/or comfort cooling contractors license as required by Section 11.32.090 of this chapter.'" Section 2. Section 11.32.080 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.32.080 Definitions. As used in this chapter the following 410 terms shall have the following meanings: (a) 'Heating and/or comfort cooling contractor' means any person, firm or corporation who installs, contracts to install or services, repairs, alters or cleans any or all types of heating and cooling appliances. (b) 'Journeyman' means any person engaged in the actual work of installing or servicing any heating or comfort cooling appliance, and who is the authorized holder of a valid and sub- sisting 'journeyman's license'. This license may be restricted to gas, or oil or comfort cooling, solid fuel or furnace clean- ing. (c) 'Apprentice' means any Person engaged in the actual work of installing or servicing any heating or comfort cooling appliance, and who is the authorized holder of a valid and sub- sisting 'apprentice permit'. (d) 'Heating and/or comfort cooling appliance' means an appliance which utilizes gas, liquid, solid fuel or electricity for the purpose of heat and/or cooling, and shall include all necessary piping and duct work, and shall also include piping for all gas appliances including such appliances as gas refrig- erators. (e) 'Furnace cleaner' means one who cleans furnaces, changes filters, removes hot and cold air ducts and smoke pipes for cleaning, and lubricates motors and fans; however, he shall not make adjustments of combustion or controls on any type of heat and/or cooling equipment." Section 3. Section 11.32.090 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.32.090 License required. It is unlawful for any per- son, firm or corporation to engage in the business of installing or contracting to install, repair, clean or alter heating and/or comfort cooling equipment or install, repair or alter any piping or duct work, without first obtaining and being the authorized holder of a current certificate of registration as a contractor issued by the Washington Department of Labor and Industries pur- suant to the provision of Chapter 18.27 of the Revised Code of Washington." Section 4. Sections 11.32.100 and 11.32.110 of the City of Yakima Municipal Code are hereby repealed in their entirety. Section 5. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
