AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning property at 1624 South 24th Avenue in the
City of Yakima from R-4, Suburban Residential Zone, to
Planned Development Zone.
WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held a hearing on the 31st day of March, 1975,
upon the recommendation of the Planning Commission that real property
situated at 1624 South 24th Avenue in the City of Yakima, Washing-
,
ton, the legal description of which is set out hereinbelow, be
rezoned from R-4, Suburban Residential Zone, to Planned Development
Zone, and
WHEREAS, the City Council finds that such recommendation of
the Planning Commission for such rezoning should be approved for
the reasons that such rezoning is in accord with good planning and
with the General Plan of the City of Yakima; that the majority of
40 property owners in the vicinity do not oppose the change in classi-
fication; that the needs of the City and community do require such
change and that the highest and best use of said property is for
Planned Development Zone, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission
of the City of Yakima that the following described real property
situated at 1624 South 24th Avenue in the City of Yakima, Washing-
ton, and more particularly described as follows, to wit:
Parcel III:
That portion of the northeast quarter of the northwest quarter
of Section 35, Township 13 North, Range 18, E.W.M., described
as follows:
Beginning at the Northeast corner of said subdivision; thence
South along the East line of said subdivision 600 feet to the
North right-of-way line of a lateral from the Natchez and
Cowichye Ditch (as said lateral was located and existed on
November 25, 1905) and the True Point of Beginning of the here-
in described tract; thence South along the East line of said
subdivision 710 feet, more or less, to the Southeast corner
of said subdivision; thence West along the South line of said
subdivision to the Southeast corner of the West half of the
West half of the Northeast quarter of the Northwest quarter
of Said Section 35; thence North along the East line of said
West half of the West half of the Northeast quarter of the
Northwest quarter of said Section 35 to a point 573.5 feet
South of the North line of said subdivision; thence East 389.5
feet, more or less, to the Easterly or Northerly right-of-way
line of a lateral from the Natchez and Cowichye Ditch; thence
Southeasterly along the Northerly right-of-way line of said
lateral 612.5 feet, more or less, to the True Point of Beginning.
EXCEPT that portion thereof described as follows:
Beginning at the Northeast corner of said subdivision; thence
South along the East line of said subdivision 600 feet to the
North right-of-way line of a lateral from the Natchez and
Cowichye Ditch (as said lateral was located and existed on
November 25, 1905) and the True Point of Beginning of the
herein described tract; thence South along the East line of
said subdivision 398.45 feet to a point situate 998.45 feet
South from the Northeast corner of said subdivision; thence
South 88 West 593.58 feet; thence North 0 West 220.30
feet; thence North 1719' West 244.3 feet; thence South 8951'48"
East 52.5 feet, more or less, to the Easterly or Northerly
right-of-way line of a lateral from the Natchez and Cowichye
Ditch; thence Southeasterly along the Northerly right-of-way
line of said lateral 612.5 feet, more or less, to the True
Point of Beginning;
AND EXCEPT that portion thereof lying within the right-of-way
of South 24th Avenue;
be rezoned from R-4, Suburban Residential Zone, to Planned Development
Zone be, and the same is hereby, approved and said real property
is hereby rezoned to a Planned Development Zone, all in accordance
with, and to conform to, the final development plan and program
therefor approved by the Yakima Planning Commission, a copy of
which is attached hereto and by reference made a part hereof; pro-
vided, the effectiveness of this rezone is subject to the following
conditions:

1. That detailed landscaping and irrigation plans be sub-
- mitted to and approved by the Office of Environmental
Planning.
2. That the developer initiate through the Public Works Depart-
ment an LID for sewer service.
3. That needed right-of-way for the east/west street adjacent
to the southern boundary of the site be dedicated to the
City.

Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared
by and for the City.
44010 Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this
ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
