AN ORDINANCE accepting the recommendation of the Planning Commis-
sion and rezoning property at 2105 Lincoln Avenue from
R-2, Two-Family Zone, R-3, Multiple-Family Zone, and
B-2, Local Business Zone, to B-3, General Business Zone.
WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held a hearing on the 28th day of April, 1975,
upon the recommendation of the Planning Commission that real property
situated at 2105 Lincoln Avenue in the City of Yakima, Washington,
the legal description of which is set out hereinbelow, be rezoned
from R-2, Two=Family Zone, R-3, Multiple-Family Zone, and B-2, Local
Business Zone, to B-3, General Business Zone, and
WHEREAS, the City Council finds that such recommendation of
the Planning Commission for such rezoning should be approved for the
reasons that such rezoning is in accord with good planning and with
the General Plan of the City of Yakima; that the majority of property
owners in the vicinity do not oppose the change in classification;
that the needs of the City and community do require such change
and that the highest and best use of said property is for General
Business Zone, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of
the City of Yakima that the following described real property situated
at 2105 Lincoln Avenue in the City of Yakima, Washington, and more
particularly described as follows to wit:
That part of the East half of the Southwest quarter of the
Northwest quarter of the Northeast quarter of Section 23,
Township 13 North, Range 18, E.W.M., and that part of Sinclair
Plat, according to the plat thereof recorded in Volume "0" of
Plats, Page 32, records of Yakima County, Washington, bounded
as follows:
Beginning at the Southwest corner of said Sinclair Plat; thence
North 0 West along the West line thereof 305 feet to the
point of beginning; thence North 0 114.61 feet to
the Northwest corner of Lot 4 of said plat; thence South 89
East along the North line ofsaid Lot 4 of said plat 140.04 feet
to the Northeast corner of said Lot 4 of said plat; thence North
0 West along the East line of said plat a distance of
59.85 feet to a point which is South 0 ° 20'19" East 150 feet
from the North line of said subdivision; thence South 89 ° 16'15"
East parallel with said North line of said subdivision 125 feet;
thence North 0 ° 20'19" West 150 feet to the said north line of
said subdivision; thence South 89 ° 16'15" East along said North
line of said subdivision 40.05 feet to the Northeast corner
thereof; thence South 0 ° 20'15" East along the East line of
said subdivision 325.10 feet to a line bearing South 89 ° 03'
East from the point of beginning; thence North 89 ° 03' West to
the point of beginning;
be rezoned from R -2, Two- Family Zone, R -3, Multiple - Family Zone,
and B -2, Local Business Zone, to B -3, General Business Zone, be,
and the same is hereby, approved and said real property is hereby
rezoned to General Business Zone.
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared
by and for the City.
Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this
ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
