ORDINANCE NO. /79
AN ORDINANCE granting modifications to a Planned Development Zone
for certain property situated north of Nob Hill Boule-
vard between 38th and 40th Avenues within the City
of Yakima.
WHEREAS, by City of Yakima Ordinance No. 1331, enacted

August 23, 1971, real property described below was zoned Planned
Development Zone, and modifications to the development of that
property were authorized by City of Yakima Ordinance No. 1590,
enacted December 3, 1973, and by City of Yakima Ordinance No. 1662,
enacted May 13, 1974, and
WHEREAS, Glascam Builders, Inc., owners of such property,
has requested further modifications to the plan and program for
the development of such property; and the Planning Commission recom-
mended granting such modifications pursuant to its hearing conducted
on May 6, 1975, and
111 WHEREAS, the Yakima City Council set a hearing for June 2, 1975,
on the request for such modifications, as a result of which hearing
the City Council finds that the recommendation of the Planning Com-
mission should be accepted and that such modifications should be
granted so that the development of such property shall conform to
the modified final development plan and program attached hereto,
now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. .Modifications to the Planned Development Zone of
property owned by Glascam Builders, Inc., situated in the City of
Yakima, Yakima County, Washington, and legally described as follows:

Parcel A: The West half of the southwest quarter of the south-
west quarter of the northeast quarter of Section 27, Township
13 North, Range 18, E.W.M.; EXCEPT the West 30 feet and EXCEPT
the South 26 feet;
Parcel B: The northeast quarter of the southwest quarter of
the southwest quarter of the northeast quarter of Section 27,
Township 13 North, Range 18, E.W.M.; EXCEPT the North 104
feet of the South 110 feet of the West 114 feet of the East

134 feet; EXCEPT the South 6 feet and EXCEPT the East
20 feet,
are hereby granted so that the development of said property shall
conform to the final development plan and program, as modified,
attached hereto and by reference made a part hereof; subject to
the following conditions:
1. That 10 feet of right-of-way along 40th Avenue and
5 feet along 38th Avenue be deeded to the City;
2. That the swimming pool area be fenced for safety;
3. That the refuse collection centers be indicated and
sufficiently sight screened;
4. That complete landscaping and irrigation plans be
submitted for approval by the Office of Environmental
Planning before issuance of any building permits;
5. .That sight screening be installed around the south-
east corner of the development to provide protection
for two existing single family residences adjacent
to the development;
6. That the driveway from the development onto 38th
III Avenue be aligned with Parkway Place.
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared
by and for the City.
Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this
ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
